Hi everyone,

 

My US Citizen husband filed an I-130 petition along with my I-485 and we were using the services of an Attorney as we are not very familiar with Immigration matters. After sending the package my husband and I received a rejection notice, in which the officer stated that the I-130 was not fully completed and was filed on a non-updated form, therefore my I-485 was rejected based on the same reasons of the principal petition, and in the notice the officer also stated to follow the instructions to correct the forms and send the correct fees and all supporting documentation and send the package again corrected. At this point my husband and I did not want to continue with the services of the Attorney for obvious reasons, we dont trust her anymore, so that we kindly asked her to give us the package returned by USCIS so we can handled it ourselves, but the attorney has refused to give us in full all the documentation returned by USCIS, she just give us 2 forms (I-765 & I-485) returned by USCIS but not the letter enclosed with the package.

Right now my husband and I dont know what to do. Should we fill out new forms properly and send them to USCIS of course without the letter by USCIS and continue with this case ( I had a case assigned but not and Alien#? or should we withdraw this petition as we dont have in full the returned documentation and file a new I-130? if we withdraw he petition,I'm afraid to be in removal proceedings as I am out of status. please some one help me with this important matter for me and my husband, we dont want to be apart just because the Attorney.

Another case of a lawyer dropping the ball...it's kind of crazy how many times I've seen similar situations on VJ. <_<

 

What was in the package? Do you know? Seems like an incredibly jerk move of the lawyer not to give it back to you...

You are entitled to all your records when you fire your attorney.  

 

Write a letter demanding your complete records with a deadline.  In the letter, state that you are entitled to your complete records and you will report the attorney to the local and state legal bar associations if the attorney fails to deliver the complete records.

write a letter to the state bar association stating how she is actively hindering you ability to process the paperwork. then just start over and follow the guides. the lawyer sounds pretty inept if they did not verify that the forms and fee amounts were still valid.

Just echoing what the previous persons stated: you are legally entitled to your papers. Follow the steps above as the person said and demand your papers back. I was in a similar situation, but luckily I work with some amazing lawyers and they gave me the same information you were just given.

I'm not sure what was in the package but I'm sure that she didn't send my USC husband's passport to proof he is a US citizen... anyway, I just want to know how  I can proceed with my case with USCIS, should I proceed with this case and send just new form and attached the rejection notice that mailed to my house? or should I withdraw this petition and start a new case even thought I'm out if status? please advice.

I received the rejection letter 2 months ago and I haven't done anything because the attorney is retaining my documents.

Same thing happened to us, but we got an RFE instead of a rejection. Just wish we could get our money back/warn others before they try to use her services.
