I'm getting so confused with filling in the affidavit of support! I have a few questions if anyone can help?

  • Country of domicile - I currently live and work in the UK, I've set up getting domicile in America (bank accounts, voting, state ID, etc..) which country do I put here?
  • Household size - I am sponsoring both my mother and husband but on separate petitions. Where it says 
    • "If you have sponsored any other persons on Form I-864 or Form I-864 EZ who are now lawful permanent residents, enter the number here." -Do I include the other person?
  • Household size - my brother is co-sponsoring with me, we will be living with him initially until we get our own place. But ATM we do not have the same principle residence as I'm in the uk, do I include him in the optional part in part 5?
  • Sponsors income - I work in the uk and I know that's not going to count towards being able to sponsor my relatives. But do I need to include all my earnings from work as those are the earnings I included in my tax return? 
  • And finally, does my brother need to fill in I-864 or I-864A? 

 

These are probably simple things that I should know but with so much paperwork to look at my mind has just gone blank!

Answers:

  • If you've set up domicile in the US, then that would be the country you would input.
  • Not sure
  • Are you combining income with your brother to qualify?  If so, that would make him a "household member" (not co-sponsor) and he would be included in your household size.  However, if you are not combining income with him, then he would be acting as a "joint sponsor" (not co-sponsor) and he would not be included in your household size.
  • Since it will not continue, there is no need to include it.
  • I-864 if he is acting as a joint sponsor; I-864A if he is acting as a household member (see my answer above).

July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Unless your mother is already in the US and has a green card, then she is not a person previously sponsored who is still a permanent resident of the USA.

*joint sponsor* The I-864 does not allow "co-sponsors"  There is a primary sponsor aka the petitioner, and then you may have a joint sponsor and/or household members.

If I have 7 times the 125% of the poverty guideline split between my US savings accounts and UK savings, would I need a joint sponsor still? Because it says the assets need to be able to be changed to cash within 12 months and my UK savings would only take a week to move to my US account. So it should qualify shouldn't it?
