I need specific details to be able to prepare correctly how I will process. To file for DCF you must be a resident in The Philippines for 6 months. Does this simply mean you're in the Philippines for 6 months? Or you must be married for 6 months while in the Philippines? Or you must hold 'resident' status, meaning that a standard 30 day tourist passport with over 6 months of extensions would not qualify you?

Call the Embassy's USCIS field office and ask. Married for 6 months it is surely not, but difference places have different requirements for what constitutes residency or not.

Agree with @millefleur to contact the appropriate embassy. I'm pretty sure you have to have legal status.

Verwen, That's awesome and great news to hear! My next concern is my proof of residency. You had a lease. I am staying at her parent's house with her, without any legally binding contract.  We have many photos and my visa shows my date of entry to the country. I wonder if affidavit from her parents is good enough proof for them or not. We really don't have any joint accounts at this time either. We have an Internet plan in her name, maybe I can put my name on that also now that I will have my ACR.  Also maybe we could open a joint bank account. I worry about that part of the process.

A joint bank account would be useful for proof of relationship too. I tried to get our internet bill in my name (pldt) but they wouldn't do it unless I had a permanent resident visa. You may be able to type up a lease agreement for her parents saying you are renting a room and get it notarized. They didn't pay much attention to mine, the woman just looked at my name on it and gave it back.

:o that's unsettling. I'll make sure to get a notarized document. Fingers crossed. It will be pretty crucial to know if I can file with DCF or not because if not then I should start filing the other documents a lot earlier and will maybe have to go back to USA and come back again because of the timelines.

In addition to Verwen's suggestions, try to seek a Baranggay Certification that you are legally presence in the neighborhood for almost 6 months, and notarized it.  Your spouse elders will surely help you with it. :)  God bless.   

 

Plus keep all the needed documents together, create an appointment online with USCIS -Manila and try it.  Have faith.

By the way if you will have the ACR with you or the ACR I-Card from the Bureau of Immigration of the Philippines that ID contains details of your present address and an enough proof of residency.  Just seek the Baranggay  or Mayor's Clearance, or any letter address to your name to justify your tenure in the address you provided.

Legally speaking.  You should be resident for over six month. In many cases a tourist visa with extensions does not qualify you for DCF. must be a resident or work permit. 

 

That is the case in the field office where I reside. Maybe where you are is different, but I think it should be the same.
