I have a question about expediting. I hadn't previously thought to take this route but a friend of mine who is married to a USC and went through the spouse visa process suggested I apply for it based on my situation which is this: I have a university fellowship beginning in the fall that requires that I am in residence. I applied for campus housing for couples knowing that my husband will be here at some point within the academic year. However, I was told that if he is not physically here within 15 days of my move in date (September 15th) then I will likely lose my housing. I am in the California bay area where affordable housing is a serious problem and it would definitely be a financial hardship for me to get housing that is not subsidized by the university. There is no  possibility of getting singles housing and moving to couples housing once he is here as all these assignments happen at the start of the academic year. Firstly, does this sound compelling enough? Secondly, if I ask for an expedite and they deny it does it harm my case at all? In other words, do I stand to lose anything by trying an expedite request? And...how does one do this? Links to relevant pages would be appreciated. Thanks!

You and anyone else that wants to file an expedite, please try.. You have nothing to lose by trying. :)  I think a lot more people get approved than get denied.. That's the impression I have. It's really up to your embassy...  Good luck.. :)

Hi All,

My original birth certificate is gujarati language and name in Birth Certificate (NIHAR) is different from Passport (NIHAL), my all document have same name as passport apart from Birth Certificate.

I checked on NVC website and it said that you can submit the Matriculation certificate (issues by school board with birth date) so I was planing to submit it.(https://travel.state.gov/content/visas/en/fees/reciprocity-by-country/IN.html

But when I called NVC and confirm they said I have to submit the Birth certificate.   so Now I see submitting only Matriculation certificate increases chance of getting REF.

So I am thinking to submit below documents. Please review and let me know if this can be better.

Translate original BC to English - get it notarized - Attach Gazette Copy
1.1  - original BC in Gujarati
1.2 - English translation with Notarized.
1.3 - Cover letter explaining name change proof registered in Gazette copy issue by Government of Gujarat.
1.4 - copy of Gazette from Government of Gujarat. which have entry of name change.
1.5 ( Optional ) - Certificate of the birth issued by Government School Board ( Matriculation certificate )

I suggest you include them all.

  1. I had read an experience by an Indian VJer ( can't find it now) that he too received a checklist for Birth Certificate. He did not have his, and hence only submitted his matriculation record. NVC came back - he was then asked to submit a record from the authorities that his Birth Certificate was not available. In your case only submitting the matriculation record MIGHT end up in the same problem.
  2. If you submit the Matriculation record as well, the NVC would understand that the name change is not recent and the record is genuine. I am sure you are having all your records translated in English (as you already suggested). Good Luck.

I think you are referring to below reply... :)

Hi,

I did not have a birth certificate and I submitted notarized affidavit from my parents ( mother and father separate affidavit) and also added my high school certificate which mentions my date of birth. Even though the website says, notarized affidavit OR high school certificate ( I submitted both) is enough for date of birth proof, I still got a checklist after 9 weeks of waiting for document review. NVC asked me to get a Non Availability of Birth Document from my place of birth Local Authority. This happened in Feb2017. I did try to contest the checklist but to no avail and had to submit the non-availability certificate. This one checklist pushed my case completion by 2 months! The clock restarts when you resubmit any document.

So you can decide whether you want to take your chances with only the notarized affidavit from parent for Birth-proof. Non availability is obtainable easily within a day or so from the local authorities.

So @chamma you agree what I am planning will be sufficient. ?

Wow, great find!! :) Yes that's the one... :D

Yes - since non-availability does not make sense in your case, I THINK this is the safest option!

Are you aware on how to Translate? @Tanish had translated couple of records(on his own, if I am not wrong) and he had no issues. Just check with him on the rules regarding it (if you are not allready aware of it).

Along with the list you mentioned affidavit from both parents affirming name change from what is mentioned in your birth certificate to your current name might be helpful. During my embassy interview the official reviewing my documents did not bother much with my School Certificate. Instead he considered Non-Availability and affidavits from my parents. I got separate affidavits from my Mom and Dad.

I got a few of my documents translated from Hindi to English and followed the NVC guidelines for translation. I got the translations notarized alongwith an affidavit from the translator asserting his capability to understand and translate from Hindi to English.

That is how I went about it since I feel that extra work does no harm.

Good luck to you.
