So are you and your spouse transferring with your companies to the US? If so, def bring those updated (recently dated) letters on company overhead paper with this info.. And yeah, if you have your recent pay stubs, def could be useful for your interview.

Taken from the i864 instructions. "For example, you may include a recent letter from your employer, showing your employer’s address and telephone number, and indicating your annual salary."

 

if you're transferring to the US with your jobs, have your American employer’s address and telephone number, and indicating your annual salary on the letters..  This could help your case at the interview since you're using assets and do not have a joint-sponsor.

if you're transferring to the US with your jobs, have your American employer’s address and telephone number, and indicating your annual salary on the letters..  This could help your case at the interview since you're using assets and do not have a joint-sponsor. 

For you @JBMG - Although i would be moving to the US on CR1 but I would be moving with a job. I was planning to take all my employment documents received from my company, but just wanted suggestions around it now. Will it create any confusion during the interview? Or it's ok to carry supporting documents from my employer?

Doesn't hurt. ;)  I mean, they'll see that you'll be contributing to the US economy ASAP by working right away and paying taxes. :) Just make sure it's on the letterhead of the American office with their contact details.. Recently dated and signed.. with company stamp (if possible).. Maybe listing out your future boss, title, salary, etc..  The more detailed, the better..  but I think in your case a simple letter and maybe  recent paychecks from the same company to prove its authenticity. :) But it's def not needed nor required in your visa type.. but like I said, couldn't hurt.. Heck, they may say just say "oh that's nice, congrats, but not take that paperwork"

Haha 😂 I threw this question only because i was in confusion. Though extra documents would never hurt but they should be relevant also. I will carry them all - with my current designation, company name, address, boss 😡, pay slips for few months etc eyc...as well as the similar documents confirming the new job...blah blah blah...!! As a last document if at all the situation occurs when they raise any questions on sponsorship eligibility (which is highly unlikely).

Item Number 2. Current Individual Annual Income. Enter your current, individual, earned or retirement, annual

income that you are using to meet the requirements of this affidavit and indicate the total in the space provided.

You may include evidence supporting your claim about your expected income for the current year if you believe that

submitting this evidence will help you establish ability to maintain sufficient income. You are not required to submit this

evidence, however, unless specifically instructed to do so by a U.S. Government official. For example, you may include

a recent letter from your employer, showing your employer’s address and telephone number, and indicating your annual

salary. You may also provide pay stubs showing your income for the previous six months. If your claimed income

includes alimony, child support, dividend or interest income, or income from any other source, you may also include

evidence of that income.

 

Item Number 3. - 17. Current Annual Household Income. This section is used to determine the sponsor’s household

income. If your individual annual income listed in Item Number 2. is greater than 125 percent (or 100 percent if you are

on active duty in the U.S. Armed Forces or U.S. Coast Guard and sponsoring your spouse or child) of the Federal Poverty

Guidelines for your household size from Part 5., Item Number 8., you do not need to include any household member’s

income. See Form I-864P for information on the Federal Poverty Guidelines.

To determine the filing requirements for your relatives included in Part 6., Item Numbers 3. - 14., follow the instructions

below.

1. If you included the income of your spouse listed in Part 5., Item Number 3., any child listed in Part 5., Item

Number 4., any dependent listed in Part 5., Item Number 5., or any siblings, parents, or adult children listed in Part

5., Item Number 7., each one of these individuals must be over 18 years of age and must complete Form I-864A.

2. If you included the income of the intending immigrant who is your spouse (he or she would be counted in Part

5., Item Number 1.), you must provide evidence that his/her income will continue from the current source after

obtaining lawful permanent resident status, and the intending immigrant must provide evidence that he or she is living

in your residence. He or she does not need to complete Form I-864A unless he or she has accompanying children.

3. If you included the income of the intending immigrant who is not your spouse, (he or she would be counted on Part

5., Item Number 1.), evidence that his or her income will continue from the current source after obtaining lawful

permanent resident status must be provided and the intending immigrant must provide evidence that he or she is living

in your residence. He or she does not need to complete Form I-864A, unless he or she has an accompanying spouse

or children.

Regarding not having W2's. 

 

I pulled the following from "Item Numbers 18.a. - 20. Federal Income Tax Return Information"

 

If you were required to file a Federal income tax return during any of the previous three tax years but did not do so, you

must file all late returns with the IRS and attach an IRS-generated tax return transcript documenting your late filing before

submitting Form I-864. If you were not required to file a Federal income tax return under U.S. tax law because your

income was too low, attach a typed or printed explanation. If you were not required to file a Federal income tax return

under U.S. tax law for any other reason, attach a typed or printed explanation including evidence of the exemption and

how you are subject to it. Residence outside of the United States does not exempt U.S. citizens or lawful permanent

residents from filing a U.S. Federal income tax return. See Filing Requirements in the IRS Form 1040 Filing Instructions

to determine whether you were required to file.

Regarding no income

 

I wasn't required to file for 2016. I included a copy of my results after completing the following questionnaire.. And wrote the following letter.

Re: Missing IRS Tax Transcripts - Did not file taxes for years 2013 and 2016

 

Dear Sir/Madam:

 

I, First, middle, and last Name, SS# XXX-XX-XXXX was not required by the IRS

to file Federal income taxes for the years 2013 and 2016 as my income was

below the IRS required level. I was not employed and had no gross income. I

attached the Interactive Tax Assistant Interview Summary for the year 2016.

It states the following:

"You are not required to file a tax return for 2016. You are not required to file

a tax return because your income does not equal or exceed $4,050, nor do

you owe any special taxes or have any special situations that require you to

file."

After thinking about it more, these are useless as it's not earned income from the US..

Yeah, you could but even after thinking about this too.. Anything can change at the last minute.. only true proof of having employment in the US is by already having paychecks from the US branch.. Your current boss could give you all the promises they want, but once you leave the country, and arrive in the US, can say "no, sorry, we're on a hiring freeze".. So in terms of the counselor, that's why this type of paperwork is irrelevant.. 

 

I was only suggesting a letter from the US employer for ILKFC if they're getting transferred because they're both living (American spouse and Alien spouse) in Hong Kong.. They're using assets to meet the financial requirement.. was just thinking an employer letter could help in their interview more than nothing since they don't have a joint sponsor.. But it's not going to be considered as proof of employment as they aren't working in the US yet...

This is a great reason why it's good idea to reply to PM questions like this on the forum(s)... I got a simple "thank you" from @pghknr in return.. So most likely he/she already got the response they needed because he/she asked several people private emails.. @pghkn, please post general questions on the forums versus sending multiple private emails to multiple people on the forum.  IF you want to ask several people.. Simply type @ and then type the name you want to "tag".. This will send a notification to them just as this message has done with you. :)

@JBMG@Eignes1009... sorry for the delay, hectic  weekend.  Anyways, 3a) i assume you are the only immigrant this section should be N/A,  or for each immigrant you need  to fill out  a different a different affidavits form.  One affidavits for each person ( waste of trees/paper if you ask me). Like i am doing for my husband and step daughter,  so i submit  2 different  affidavits,  made no mention of either on the other application. Hope that helps, For financial  evidence,  you need an updated  affidavits with 2016

 income for interview  along with 2016 transcript/ tax return and W2... Again extremely sorry and the long wait for responding,  i know how stressful it is to wait.

@JBMG i received our interview date a day  before it shows in transit or confirmation email.  I called received a date and was told it was just schedule. the next day i received  the confirmation email then status changes ti in transit,  now ready...... hopefully  approved  soon
