Hi, I got married recently and applied for my GC adjustment of status and I got my application approved and the they are processing it right now. After going through lot of problems regarding denial of I-485 because spouse didn't make enough money last year. I am in the same situation now. I am asking this question in advance so that I can be prepared for that.

My wife was in college last year so she didn't work and didn't make any money but this year she is working and making 25000$ which is above idaho poverty line. I want to know what all problem I will face and what option do I have because my I-20 expired may 10/2017 and m in the legal status because my application is approved. So if i485 is denied then what all I should do and what option do I have.

Any help is appreciated

thanks

I'm sorry, did you go through a denial with the same spouse?

I didn't get any denial yet. My application is in process. There was a typo mistake.

i am asking this question because I read lot of post like this and them getting denied because of spouse income. So I asked this question so that I can be prepared in future if I get the denial for same reason.

That amount is for one year.. remember we are only half way through the year. so she is technically not above the poverty line.

The income requirement is to show stable financial support. So you guys will still need a co-sponsor.

I'm going to say maybe not.  There have been those who with about 6 months of proof adjusted without a problem.  It's probably a good idea to err on the side of caution, but may not be necessary

Yeah we replied for our RFE with the documents we had and added her employer letter stating that she will make more that 25k$ depending on her bonus.

Since we have send the document already . Now I want to know what should I do. If it gets rejected will I go out of status since my I-20 expired may/2017

No worries with that. Let's hope it does not get rejected and you simply get an RFE. However, if your application does get rejected, immediately submit another application and I believe you'll go back into AOS status.

My income was around 7000$ because I was student too. And I got RFE already and we replied for it with the w-2 we had of my spouse which shows she didn't make any money because she was in college.

Sorry to hear. Any chance of a a third party sponsor? Did you add your assets? A car? Money in accounts?

I added money which is not much like 2000$ in total. And car we have is like 4000$ in total. So we don't have any asset that would reach above poverty line.

No third party sponsor either

At this point there is not much you can do but wait to hear back from USCIS. One thing I know is they want current income and not future/past. Letter from employer would have helped but for mention of bonus (not guaranteed). What you should do in the meantime is try very hard to find a cosponsor. Ask family and friends ( yours and hers), boost her income ( 2nd job / drive uber), find a job off campus if you have EAD and use your personal income to supplement. Be proactive and get ahead of them that way if you receive RFE you are ready for it and if you don't you have the extra income.

Car couldn't count unless you had more than one anyway

It sounds like you will have to wait until you get a response from USCIS. In the meantime, try supplementing your income and/or finding a joint sponsor.
