Living apart and I-751 evidence.

Hi everyone,

 

    I am Doctoral student since 2013 before we got married in May 2015. After that I applied for adjustment of status and I got approved 2 weeks after the interview. Then I tried to move to Chicago where my wife life because she is working there. I applied for university there but I got rejected because they said u already have been accepted at different university in Michigan and PhD students seats are limited so I decided to continue studying at my university during the 2 years. We visited each other once in about 2 months bc of my study and her work. After 2 years I moved to Chicago where my wife live a month ago and now we r living together happily. I will graduate sometime in Aug. I will file for remove condition Jun 20th.

 

Here is the evidence.

 

Dear USCIS examiner:

 

Enclosed please find:

 

  • Completed I-751 JOINT Petition to Remove Conditions on Residence.
  • Check for $680 to the U.S Department of Homeland Security.
  • Photocopy of both sides of my husband’s Permanent Resident Card.
  • Photocopy of my husband’s passport and his student ID.
  • AR-11 Change of Address form.
  • Letter of explanation our situation and why we lived apart.

 

Enclosed also please find the following documents to verify the status of our marriage and ongoing relationship:

 

  1. Evidence of Joint Ownership of Assets and Shared Financial Responsibility
  • Illinois Driver License showing same home address.
  • Copy of joint deed of our house.
  • Copy of joint car title showing co-ownership of property.
  • Copy of joint Bank of America checking account statements since May 2015.
  • Copy of joint Chase Bank checking account statements since Feb 2016.
  • Photocopy of 12 credit cards shows both of our names as authorized user.
  • Copy of void checks show both names from Bank of America and Chase Bank.
  • Copy of joint tax transcript of 2015.
  • Copy of joint tax transcript of 2016.
  • 401K show my husband listed as beneficiary.
  • Copy of life insurance shows the other spouse listed as the beneficiary.
  • Copy of joint car insurance.
  • Copy of joint Water and Electric utility bills.
  • Copy of power of attorney for financial designating each other as the executor.
  • Copy of health care advanced directives and power of attorney for living well documents designating each other as the executor
  • Letter from US Bank denied us to be in joint credit card.
  • Letter from Bank of America denied us to be in joint credit card.

 

  1. Photographic Evidence
  • Photo stating time, dates and places for visiting each other during the two years and on the back of each picture has more details.
  • Photo of us with family in Thanks giving and Christmas.
  • Photo of us celebrating our birthdays.
  • Photo of us in our 1st anniversary vacation in May 2016.
  • Photocopy of Hotel reservation receipt in Chicago for our 1st anniversary in May 2016
  • Photo of us in 2017 New Year with a family.
  • Photo of us in our 2nd anniversary in May 2017.
  • Facebook photos with likes and comments from family and friends.

 

  1. Other Evidence
  • Birth Day, Valentine and Christmas cards addressed to each other.
  • Phone Statements bill show’s our calls to each other for two years (Highlighted) since 2014.
  • Emails between the University of Illinoi at Chicago and My husband.
  • Letter from the University of Illinoi at Chicago denied my PhD application to transfer to them so we can live with each other during my study.
  • Student transcript from Jan 2013 to May 2017.

 

Any advice would be greatly appreciated!

Timeline

Personally, I don't think you have anything to worry about.  You have a valid documented reason for temporarily living apart, and yet you still have a lot of evidence of the co-mingling of your marriage.  Since you are just filing the ROC now and it is taking a year or so for review, you presumably will be back home with your wife by the time any interview occurs.
