Hello. So here is my story.

 

I moved back to the US May 2016 for work from the Philippines. I am a US Citizen. My then gf applied for a visitors visa and got approved. Her initial plane ticket was July 12-Aug 9. She did not get on her return flight. We got married in November. Here visa expired January. I had to wait until I got my Tax Return and gathered all the other docs for AOS and filed it mid March. Will her not getting on the return flight be an issue? Will it be questioned at the interview? What about her over staying? I read that her over stay will be "forgiven" but just want to be sure.

It should not be an issue for AOS.

 

It won't be "forgiven" (it doesn't go away), but it will be ignored for AOS purposes so it won't be an issue.

9/5/18: Interview scheduled notice, 10/17/18: Interview

10/24/18: Green card produced notice, 10/25/18: Formal approval, 10/31/18: Green card received

What about the return flight?

Was it canceled? If so, then there's no issue. If it wasn't, then there's a slim chance that the system indicates she left the US. Although I still don't believe it will be an issue (it's usually only an issue if somebody filed for AOS before the return flight....since leaving the US abandons AOS automatically).

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
