I do!  I'd much rather be in this waiting period....living with my spouse and having a life.

Thank you for the words of encouragement :) I forgot about that period...It's just the wait...it's killing me. Lol. Not knowing things and being up in the air...

It's been almost a year. You are correct. Time flies so hopefully more update, good ones, are coming really really soon. Fingers crossed

It's such a waiting game.... I filed June last Year and mine has been transferred to the local office. When I called a couple of times they told me different reasons for this, one agent said I might be getting an interview another agent said its because of the backlog.

I filled my I751 jointly June 2017, it’s been 11months now that I filed. I and my spouse have been going through some ups and down and I decided to file for divorce. my lawyer filed the divorce last month. However, I have been worried because I thought I need to notify USCIS, I discuss it my my lawyer and he said the immigration rules and procedure on this issue are not clear to him, Therefore, He want to speak with an immigration officer to get a better feel for the procedures that will be applied once UCSIS learns that I have filed for a divorce. He further said if I choose to tell, USCIS might ask me to start a new application or denial my application. Please anyone with clear understanding should help me.

Sorry to hear that! I honestly have no idea, but I encourage you to consult an immigration lawyer asap! Also, post your question in a standalone thread of this website there is alot of great people and experiences that they can share with you until you speak to an immigration lawyer or make a decision!

It's my understanding that if you file for divorce. You have to immediatly let USCIS know and then apply for I-751 again as a Waiver case.

If you choose to not do this, you could run into possible issues in the future.

 

1) You could be called into an interview and they will probably deny you on the spot for not letting them know you got a divorce (they may see this as trying to avoid immigration laws)

2) Everything could go 'smoothly' and you may get approved for the I-751.. but when you want to renew the 10 year green card or even apply for citizenship .. you will need to show your divorce certificate and they could possibly catch that you were wrongly approved for your i-751 case since you were approved based on marriage to U.S Citizen after you got a divorce and things will get messy there too. 

 

My opinion here is keep in contact with USCIS and update them every step of the way. This will go long ways when you interview with them if they choose to do so.

The problem is sometimes, they ask for the divorce decree right away, and they don't give enough time for you to get it and respond to the RFE. Some divorces can take longer than expected. So I would wait a little bit, then ask for a divorce waiver (you don't have to re-apply the whole I751) to get your jointly filed I751 treated as divorce waiver.

I would recommend posting this as a separate thread in the main ROC forum. You'll probably get more eyes on it and better answers.

ROC Timeline:

May 31: Package mailed    

June 8: NOA1 received, dated June 2

June 27: Biometrics done

Sept 25: Case Status Update Card in Production

Hey, guys..

Today I've received a letter, from USCIS, and it states that they've received my case..??? (I thought they received it a year ago, lol :) and they will use my previous bio metric..blah-blah.."  Well,  I had my bio done 10 months ago.

 

 I've also noticed they use the original (NOA1) number. Not the number we've gotten with biometric appointment (CR #)... Did anybody else receive the same "thing" in the mail?.. The Notice came from California Office.

So weird! I haven't received anything in the mail at all...Received an email AFTER I submitted an inquiry because their email to me said to inquiry if I don't get a notice ...I am confused myself..

Seems like a lot of July 2017 filers got something in  mail today as well... Some - the same letter as mine, and some - finally received their biometric appointment, the first one, after 9-10 months of wait...with a wrong zip code. So now they have to fix it somehow because there is no way you can get  your bio done in Illinois if you live in Florida for example....

 

Went through Augest 2017 thread - the same story.   What's going with CSC.. ??? :wub:
