I'm glad I-865 was filed regardless you were told your wife doesn't have to.. 

 

I-865 instruction states this very clear : "If at any time in the past you completed Form I-864, Affidavit of Support, to sponsor an immigrant, you are required to report your change of address within 30 days of the change if the sponsorship agreement is still in force."

 

There is nothing about "spousal exclusion " to report such change in the instruction. Or  - that only co-sponsor has to report a change of address - not a word. Your USC wife completed Form I-864 - she is a sponsor. Simple. Period. 

 

... I agree with people in that thread you've been linked to - probably, there is no "punishment" for not submitting Form I-865 within 30 days or at all... But once it's been learnt the I-865 had to be provided, - it's really  a good idea to submit it now and send a copy of that (AR-11 & I-865) along with your I-751 package.

 You are welcome. I didn't mean to mislead you. I'm sorry about that. But all my friends had filed RoC, their spouses never filed I-865. And some of them are now USC. That's why when your question came up and I asked them, they didn't even know about I-865 form. And my husband didn't file either.

Thanks and We are lucky to part of the forum. We never misunderstood from your replies. You have written that is truth and working for all. As you said your husband didn't file either.

For a save reason, my wife filled the I-865.

I am finished calling USCIS about form I-865 and talked to an agent named Kayla. She never heard an I-865 form. She, instead corrected me saying that maybe I meant I-864 which is not. I told her, yes I know about I-864, my husband had to provided it for me. But she said had no idea about I-865. :unsure:. I told her I am calling because we don't want to get in trouble for not following the rules.

 

I am dumbfounded...

I''m with USCIS customer disservice line right now... they have never heard about  'verification of inclusion of a dependent in filing form I-751" either.... I think  I'm done calling them - the time you wait for someone alive to talk, plus while the supervisor calls you back - it's exact time for me to get St.Louis for Infopass ... So frustrated...

I called USCIS again and was talking to Tier-2 agent named Daniel. He confirmed that my husband has to file I-865. Even I already filed for I-751 that clearly stated my husband and I filed jointly and living at same address.

 

If you wanted to talk to Tier-2 agent ( seems knowing the rules much better), please call 1-800-375-5283 and press 123 when the voice asking you to change your address. It worked better that way for me. I tried several times whenever I wanted to talk to Tier-2 agent.

 

We will going to file tomorrow even though on I-751 clearly stated I am living with him at same address. Oh my!

Thank you for your advice, how to get a Tier 2 immigration officer...  Next time will definitely  try this 123 :) But today had to call, to press all those 1,2,4.9..whatever... talk with h person#1. No help, of course,  was transferred to a Tier 2 and told they will call me in 30 minutes. They did call, and the person #2 happened to be really helpful.. Finally :)

 

So, this is what I've learnt today, and I think we all should know that. 

1. I was told by a Tier 2, that my son's Extension Letter was sent, on June 19. - this is the date when MY Extension Letter was sent.

2. His biometric appointment letter was sent on June, 30 - this the date when MY was sent. I received my yesterday.

3. Son's biometric is scheduled at the same day as I have my appointment, July 17, which is next Monday. 

 

But the thing is - we have never gotten anything for him...NONE!!! The IO I talked with said that USPS may not deliver mails from government if a post office clerk doesn't see an individual resides at the address on the envelop...

 

Well, we all live at our address since 2014, and have never had any issues!!!  During AOS all our paperwork arrived together, envelope by envelope, always at the same day, including green cards...

 

And i believe this is how it was supposed to be and THIS time. It's just that "awesome' moment, when USCIS did everything nice, trying to keep a parent and a dependent on the same schedule , but here we are - USPS!!!! screwed things up :devil:

 

So, I went to the Post Office right after I've found out all about this. The lady - she is usually very helpful and nice, she knows me and my son... - she did a research, trying to find son's letters, and after some time she told me that they got new employees, and looks like "the girls" sent my son's mails back...???!!!! 

 

I don't care right now about his Extension Letter - will fix it later, but  biometric appointment..?? It's scheduled for the next Monday, and even if I put a e-request, to send it to me AGAIN - there is a big chance we won't have it by Monday anyway..

 

I was given his WAC #, so at least I can see his status at USCIS website.. Yes, clearly it states "we've sent you a Notice.... blah-blah..."

And the guy, a Tier 2, promised me he will fax son's biometric appointment letter... I don't know if they actually do that and if it's gonna happen.. but I know that WITHOUT the  letter my son won't be allowed to get his bio done...

 

What, guys, do you think we should do at this point?....
