Was your second letter a copy of the official letter?

Im asking because I received my second letter was a copy not official.

Yes, second letter is an official letter.  i dont quite remember the whole detail.  but i remember it says use that letter along side with the expired GC as documentation for work/travel.  This is the 18 month extension letter.

That’s what my concerned is. I received a copy not the official letter. And when I called uscis (several times in a week lapse) They told me it was an automated system of send outs.

I did spoke with a tier 2 :(

if your case is still in process on the uscis website, i wouldn't be too concerned about not getting an official watermark letter about extensions.  if you need to work or travel, just get an stamp by scheduling an infopass appt.  otherwise, your recourse is either speak with your local representative or immigration lawyer.

Thank you! I think I’ll wait until 3-months before  my 12-month Ext letter expire to request info pass for stamp in case I needed it for my job.  Another thing I read from other people is that the cond gc is taken away when you request stamp 🙄

You are still in normal processing time. No?

Mine is an I-797 Notice of Action. It's an official notice not a copy.

Thank you! I think I’ll wait until 3-months before  my 12-month Ext letter expire to request info pass for stamp in case I needed it for my job.  Another thing I read from other people is that the cond gc is taken away when you request stamp 🙄

After you file I-751, you should get the initial 12 month extension but the expiration date of your status is according to your GC not the date of that letter. So if you are near the two years of the issuance date of the Cond GC, then you will need the I-551 stamp, which doesn't cancel your conditional GC, rather it extends it. There is a line on that stamp for reason and it should read some like I-751 pending, your case number. It also says you are authorized to work until XXX date. Thereafter, if by the end of that 12 months, your application is still pending (uncommon) then you have to make sure you get another I-551 stamp. So long as your application is not rejected, the conditional GC stands.

As for job, once they verify you according to I-9, they shouldn't request for additional evidence. Wal-mart, Apple, etc, have run afoul of that rule and were fined. The idea is that if you are granted a conditional GC / PR, let's say you didn't file I-751 for RoC and you just went along with life. USCIS will eventually find you, and put you in deportation. Until the gov takes that step, your GC actually still stands. Now if your company uses E-verify, they might catch on a lot faster than one that doesn't use it. The point is USCIS will have to take that step first not HR. Anyway, this is all academic.... don't sweat it. Just make sure you aren't out of status.

Hope they will fix this issue and sent out the official letters. Or even better to received our approval 🙏

Since the RoC is taking so much longer these days (used to be less than 12 months, now it's at least 15 months), it's creating issues. I don't think I have heard of the 18 months ext before. So maybe they are just trying to cover many cases. If you are really worried and is close to a field office, get an Infopass appt. They can at least tell you if what you got was official communication.

When I went to get the stamp, she was telling me they are interviewing more I-751 people, but again, she never did say if those I-751 applicants also filed N400 later cuz if they did, interviews for naturalization is mandatory from my understanding and that would skewer the numbers. Historically, not many I-751 get interviews on its own and the condition is usually removed long before N400 eligibility. But as we are getting into 15 months approval times, there are many more overlap with N400 now. That's my understanding.

I’ve been on the phone twice with USCIS but not sure what Tier 2 is. Can you explain?

I see someone has explained this already and I know you have your Senator involved. Try calling the USCIS number and ask to speak to Tier 2 customer service because you want to make a case inquiry. Within 2 weeks, you will receive an update of some sort, whether they are still working on your case or what's going on. It doesn't hurt to try. I'm sure your Senator is great but I have done Tier 2 requests in the past and these representatives are very helpful people (some are not, bad days happen). 🙂
