Hi everyone,

Finally it's time for me to file my ROC, I just had a few questions as you all know these things could be really confusing!!!!! in the I-751 form there is a part for spouse information and signature so I had my husband sign it but then I was reading somewhere only if your husband is filing for ROC with you you should complete it,my husband is a US citizen so should I have him sign it or not ? Also is tax return not gonna be enough? I was reading in other topics that you need tax transcript! I'm so confused :cry:And the last question is about Biometric fees,I don't know If I have to pay it or not,It said if your married to a US citizen you don't need to pay Biometric fee and they would ask you to pay it If they need you to! Can you guys answer my questions please? I feel like everything is so confusing now,I was not like that 2 years a go when I was filing for GC ! lol :lol: Thanks in advance

If you are referring to Part 8 of the form then YES! Your US Citizen spouse needs to sign it.

And the last question is about Biometric fees,I don't know If I have to pay it or not,It said if your married to a US citizen you don't need to pay Biometric fee and they would ask you to pay it If they need you to! YES each conditional resident needs to pay the biometrics fee. I assume only those that are qualified to get Fee Waiver are allowed not to pay. Otherwise, I would love to skip that payment too LOL

 

Can you guys answer my questions please? I feel like everything is so confusing now,I was not like that 2 years a go when I was filing for GC ! lol :lol: Thanks in advance

Part 8. - for spouses. So your husband does right, signing that :)

Tax Transcripts or Tax Returns.. Both work fine. Just Transcripts are easier for submission - they don't take that much space as actual Return.. Plus Transcripts prove you have really filed your taxes with IRS.  

But as I said before - either way works. For my K1 and AOS we used Returns - no problem. Since my AOS was pending 15 months, we got RFE for the most recent Tax Return.. RFE letter asked exactly for Return and W2', not for Tax Transcripts. 

But if you would like to go with Transcripts, you still have enough time to get them before your ROC submission

And yes, biometric fee must be paid  - filing fee $595.00 + $85.00 bio fee.

I didn't print that either !!!! But I guess I'm going to since I still have time. In the letter that I got from USCIS as a reminder It just said send Tax Returns. I also don't want to send too much document.

No, you are goood ;):) W2 - with Tax Return, but if you submitted  Transcripts - W2', 1099's and etc - not needed :)

the same - if you go with Tax Returns, you should include W2', 1099's

If Tax Transcripts - submit just those "couple' pages you'll have from IRS :)

Rule of the thumb for ROC, the more evidence you can send the better to avoid RFE that slow down the process of your application. Check CookieCat list of evidence, that is one good example of evidences, no RFE no interview invitation, her online status just changed to card production. USCIS wants to see all the evidences that you can provide for the duration of your marriage since day one to present.
