I'm confused about the expiration date of my one year extension letter. I was talking to a lady at the office via phone and she told me my extension expires on the day my LETTER was dated which is July 12 2018..My GC expired on Sept 27 2017 ....I am traveling back to my home country August 8 ..y daughter is getting married, my plane tickets are bought ...I can't get a appointment to get my 551 stamp... I asked her what I'm supposed to do if I don't get it in time , her response " you can go but they might not let u back in the US " ...what to do ??? What date do I go by ???

Technically, an Extension Letter extends your green card for a year.

"Notice of Action. A Conditional Resident with an expired Resident card (with a two-year expiration date) may be boarded if also in possession of a Notice of Action (Form I-797). The Notice of Action extends the validity of the card for a specified length of time, generally one year. The “Receipt Date” of the form has no effect on the validity of the card. A passport is not required"

 

But some air companies, actually their ground employees,  still "believe" they should go by an Extension Letter date... 

 

So, I'd advise to print the Guide (link above) and carry this with you. Just in case. Also, I'd make an Infopass closer to your departure date - trying to get I-551 stamp anyway. 

 

I'll be in the same boat with you - leaving US in August and coming back in September, after everything is expired. So I'll try to get a stamp before I leave...

Hi all,

I just had a look through the USCIS website and found this regarding the I797. It was a handbook for employers to refer to, it states:

  • The combination of an expired Permanent Resident Card and a Form I-797, Notice of Action, that indicates that the card is valid for an additional year, is an acceptable List C evidence of employment authorization for one year as indicated on Form I-797. At the end of the one-year period, you must reverify.

Your egov site updates during the day, never at night or morning. Normally between 4 to 5:30pm but sometimes it may update around noon to 1:30pm. The dhs my account site updates early morning hours. If you want to find out if your case is approved then check the egov site around 6pm every night

some interesting information gathered at my info pass appointment today

 

1) the stamp on my passport has expiration date 1 year from today, not 1 year from the GC expiration date

 

2) the officer told me: great news! the Socal office is processing your case. I asked her, you mean the SF office(since my online status shows case received by my local office), and she said no, the office which issued the extension letter is processing my case but she could not see how much longer it will take

 

I also told her I applied for N400, not sure if that will speed things up

 

info pass process is very easy, in and out within 30mins, and yes you can bring your phone and purse, and it's okay to use it.

 

She did ask me if I have any near future travel plan and i said yes.

AOS Filing progress:

Package Filed: Dec 16

USCIS Receipt Update: Dec 18

Bio Appointment : Jan 16

RFE Receipt: Jan 23

RFE USCIS Receipt: Jan 28

EAD Approved: Feb 23

This will be interesting to track....let us know how true this really is.  Love to hear CSC is going to start pushing the approvals out.
