RFE(Request for Evidence) - First Name Mismatch on Birth Certificate

Hi Everyone,

I've researched everywhere for solutions to my issue and so far nothing has been helpful. So, I'm making my post and hopefully it helps me and someone else with a similar problem.

I filed Form I-130 petition for my mother who is abroad. I am a US citizen. My original birth certificate, which was done in the 1980s has my mother's nickname as her first name (My dad filed my birth certificate). This is the birth certificate that I've used for all my immigration related paperwork. However, my mother has never used that nickname/first name in any of her official documents. So, there was never an official change of name anywhere since she's never used that name anywhere else except at her hometown where they still refer to her by that name. While filing for my mother's paperwork, my birth certificate was corrected to have my mother's official names on there so as to match all her other official documents.

The problem is, USCIS has records of the nickname/first name in my original certificate and now they want evidence to show that both names belong to the same person. They also said they do not want affidavits. We can't legally change her name since her nick-name was never used officially.

Has anyone faced a similar situation or know someone who did? How did you go about it? Thanks for any and all input.

how did you legally change your birth certificate without any legal document changing the name? I would recommend making an infopass apointment to talk with someone about what type of evidence you need since this is an odd position you got put in.

My mother provided an affidavit, copy of my original birth certificate, her ID and they were able to change it. They also had misspelling in my original birth certificate so that was corrected as well,
