Because you are privileged to use the ESTA waiver program, you will be asked by the consulate officer why you want to obtain a visitors visa. Explaining this situation to him/her like you are to us now, will end the same way as people are warning you about. It will be seen as unpaid work. It's not like you are just hanging out there for a couple of weeks, go see the baby, sight-see a little. It's that you want to stay there for as long as possible to help her out taking care of the children. Therefor, 95% chance the CO will deny your request. A denied visa means also you lose your ESTA waiver privilege. 

You could fly out on, using your ESTA privilege, a day before she is due and stay for 90 days or a little less. But even then, CBP can give you a hard time at the border if you tell them the purpose of visiting the US.

I can't stress enough again what a huge privilege the ESTA/WVP option is. A lot of people on this forum would be jumping for joy if they woke up the next day with a passport from a VWP country instead of having to apply for a B (which comes with stress, expense and of course the high chance of refusal). Take advantage of what you have and your sister should also be grateful for that.

 

A while back on VJ, there was a woman here from Pakistan whose mother died in the US. Her B-1 visa was refused. She wasn't even allowed to say good bye to her own mother or attend the funeral. So the fact that you can go and visit your sister for three months automatically merely because you have a French passport is something you should understand is indeed lucky.

I know that's a privilege and all. I was just asking a question in case there were any other solution. I have my answer. 

Reading you, it feels like I am asking for more than I deserve. 

I understand that it will be difficult to have a tourist visa. Thank you for your answers

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
