Hello all, My fiancee and I received our NOA1 of March 11 2017. I'm going to Vietnam this June and we're getting married there. My parents and sister will also attend. I know to save pics, receipts and all that. This is my second time visiting Vietnam. I wish I could just go to US embassy and bring my wife home with me but like I said, "wish." Does anybody have advise to help us with the immigration process since we'll be together between NOA1 and NOA2? Thank You

Once you marry, your K-1 process will no longer be possible and you will need to restart with a CR-1 visa.

Nope, don't get married because that will add time to your process.  You will throw away the initial filing fee and get to start again with the I-130 spouse petition.   Go and have the engagement ceremony.  Take lots of photos.  But be sure it is the engagement ceremony, with photos of her family and your family ( or stand-ins) doing the traditional ritual.  

 

DO NOT DO THE MARRIAGE PAPERWORK AND SIGN THE BOOK AT THE LOCAL GOVERNMENT OFFICE (that's the only thing that makes a legal marriage in VN).  You can have a nice party too with family and friends.  

 

The folks at the Consulate know what it ought to look like so don't try to "sneak" something by.  Don't talk about each other as husband and wife.

Very wrong.  Married is married anywhere in the world.  You can have a party, but not a wedding.

 

VN is one of the tougher places for family visas.  Spend some time reading in the Vietnam regional forum to learn the ins and outs.  Don't get tripped up.

This is even more confusing to us from the US. We might not see it as a wedding but it might be seen as "too married " for a K1 but "not enough married " for a CR1. Most advice is just avoid it all together until after your US ceremony

I don't think so. Did you misunderstand the k1 visa? Did you and her include a statement saying you intend to marry within 90 days of her entering the US? I think it will be confusing for them if you state that you're getting married in June AND you signed an intent to marry in the US statement. At this point they may need some sort of proof that you DONT get married in June so I'm not sure what to advise you further

No. USCIS will not accept any additional evidence on an I-129F unless an RFE is issued.

Takes 9-12mo to get a CR1 in Vietnam.

 

It takes 30days to get the license to be officially married so better be in country for a while.

 

If pursuing the K1 I'd just have an engagement ceremony and marry officially once you are in US.

 

You can always have the ceremony and reception next time you are back.

I understood the K1 process but did not realize a wedding without any public record would have in validity to the K1 process. We did sign letters of intent to marry withen 90 days upon her entry into US. So we will make sure not to marry.

 

Now that my we probably will not get our NOA2 on the first go around does anyone one know how long it takes to resubmit any needed clarifications to USCIS?

Wait for an RFE if they issue you one. You can submit your clarifications once you get the RFE

Instead of wedding, I can suggest that you could get engagement ceremony done in June in VN. Unless you have already done engagement ceremony. 

 

 

For K1 interview in VN embassy, engagement ceremony and photos are very useful to prove your legitimate k1 visa.
