I am the son of a US Citizen and now 22 years old. Previously i had filed i-130 in immediate relative category, but the visa was refused at the consulate because the petitioner's domicile was not established . I want to know that if I want to immigrate to the US ; now in the first prefenrece family category, do I need to file another i-130? Or i can file i-864? In the latter case will the initial priority date be the same and another nvc processing will happen ?

My father (US Citizen/Petitioner) is staying with me in India. The visa was refused at the US Consulate; however they gave us one year time for him to reestablish domicile. I want to know if we are unable to do so and this visa expires; do i need to file i-130 again or can i file i-824 and restart the process with the same priority date(but this time another category as I am above 21 now)
