Hello,

I'm a F1 visa student living in San Diego. I'm planning to marry my girlfriend (we met in 2015 but has not lived together) and ask for the green card.

I'm here hopefully I could get a guide for what I'm doing. 

What paperworks needed to be done?

Where to get the marriage license? 

Should I find a lawyer to present us and make sure we could pass the interview so I could get the green card? I'm going to apply right after we get married. Is that good?

May I apply for working permit while applying to interview for the green card? 

Please give me your advices. Thank you!

How to get a marriage license varies from area to area (usually from county to county). Google or asking any locals are probably your best bets.

 

Unless you have some red flags or complexities in your case, an attorney is not needed. DIY is fine. An attorney can't answer the questions for you at the interview.

Yes, you can file for an EAD (and AP) along with your AOS. Once approved and obtained (~3-4 months), you will be able to work or travel abroad.

Sure:

AOS = Adjustment Of Status. This is via the I-485 form. Upon approval, you will have Legal Permanent Resident (LPR) status, and get a green card.

EAD = Employment Authorization Document. This is via the I-765 form. Once obtained, you will be able to obtain work while your I-485 is still pending.

AP = Advance Parole. This is via the I-131 form. Once obtained, you will be able to leave (& re-enter) the US for short trips while your I-485 is still pending. Without this (or a green card), your AOS application will be denied if you leave the US and you very likely won't be permitted back in without an a CR-1/IR-1 visa.

 

You can file for an EAD and AP at the same time as the I-485. There are no fees for those forms when filed with the I-485.

 

Edit: In your circumstance (and as noted in the guide linked above), you would be filing the I-130 (and supporting forms and evidences) concurrently with the I-485. The I-485 grants authorized stay while your AOS is pending.

Your questions seem to have been thoroughly answered above. As for the lawyer, I recommend! Just to avoid any problems. I went through without a lawyer and I regret it. I could have saved myself so much time and disappointment if I hired an attorney.

Hello guys, 

 

I have another question here. I hope you guys could help me out. 

 

I finally filed for AOS. I did the biometric fingerprint on this Jan 3rd.

 

Recently, I've been told to be out-of-status from the school.(I am F1 student - My I-20 is valid until May 26, 2018)

 

I do full-time studying (12 units) but I failed 1 class (3 units) last semester - so I failed to maintain the full-time studying commitment.)

I wonder if I should do the reinstatement process follow the school's instructions. I am planning to continue my study though.
