I-751 and children born before marriage

We will be filing our I-751 later this year and I had a question about supporting evidence. We have two children together, but they were both born before our actual marriage. They are our biological children , and his name is on their birth certificates. Should we still provide copies of their birth certificates as evidence?

No you're wrong. The purpose of the birth certificate is to establish proof of bona fide relationship and only applies to children born within the marriage between petitioner and beneficiary. Here's the instruction that say so..

 

Evidence of the Relationship

Submit copies of documents indicating that the marriage upon which you were granted conditional status was entered in “good faith” and was not for the purpose of circumventing immigration laws. Submit copies of as many documents as you can to establish this fact, to demonstrate the circumstances of the relationship from the date of the marriage to the present date, and to demonstrate any circumstances surrounding the end of the relationship, if it has ended. The documents should include, but are not limited to, the following examples:

1. Birth certicates of children born during the time of this marriage, if any;

No you don't have to send any copy of birth certificate since you don't have any children with your petitioner in this marriage; however, where it asks specifically for your child's information put your biological child only and select ''no" where it asks if the child is applying with you. You can only answer "yes" if the child is in the U.S. and is applying to remove conditions as well with you.
