clarification of what is going on

Filed: K-1 Visa Country: Philippines
Timeline

Fiance just had interview this morning. Looked to see status on website, could not pull up case under "Non Immigranting Visa" ( filed a K1 ) said had wrong case number. Changed it to immigrating visa and the case pulls up as ADMinistrating Processing". What is going on?. Have not been able to get ahold of her since no phones are allowed in embassy. Worried now this is going to be denied and where we stand. any explanations?

Everybody goes through AP after the interview. Some only for a few hours, others for weeks or months.

K-1: 12-22-2015 - 09-07-2016

AP: 12-20-2016 - 04-07-2017

EAD: 01-18-2017 - 05-30-2017

AOS: 12-20-2016 - 07-26-2017

ROC: 04-22-2019 - 04-22-2020
Naturalization: 05-01-2020 - 03-16-2021

U.S. passport: 03-30-2021 - 05-08-2021

The changing between non-immigrant and immigrant is normal and so is being put in administrative processing. 90% of the time it's them processing the visa and making the visa packet. Once they are done, it'll change to Issued.

01/13/2016: I-129F filed  07/15/2016: K-1 visa in hand
10/13/2016: Filed AOS + EAD/AP.   07/07/2017: Permanent resident (Conditional)
04/16/2019: Filed ROC  11/17/2020: Approved. (10 yr GC)

 

Naturalization                                                        
09/02/2020: Filed (Online)    09/08/2020: NOA1: (NBC
10/22/2020: Biometrics Reuse Notice.  12/22/2020: Online Status Changed to Interview Was Scheduled.  
01/29/2021: N-400 Interview - PASSED! 01/29/2021: Same-day oath ceremony.

Nothing unusual going on, as noted everyone does their time in AP.. how long depends on the case file.

The K-1 process is quite strange. For a time, it is both a non immigrant and immigrant visa type. As you go through the stages, within the NVC system you look up your file under immigrant. It stays that way until after approval and ready for issue. At that point, it changes over to non -immigrant. It truly is a non immigrant visa with immigrant intent.

 

Just about everyone gets placed in AP.  Based on the discussions I had with the case officer he informed me of the steps for Embassy Manila:

 

1. the first AP is the immigration unit doing the paperwork for approving the visa

 

2. the first ready is a notice that they are finished and the paperwork is being sent for visa issuance

 

3. the second AP is the visa issuance people doing their own paperwork

 

4. the second ready is that the visa has been issued and is currently being processed for delivery

 

Then "issue" is posted and the visa has left the BIG house to YOUR house.
 

More patience is needed.

Timeline

At USEM the K-1 is treated totally as an immigrant visa during the application process, all information is under the immigrant visa headings. 

 

Status will be under Immigrant visa after the interview, status goes from READY and/or AP until it finally shows ISSUED status.. this is when the visa is actually APPROVED, after that the case file is packaged and the visa is ordered for printing.  Once all is done the visa status will show as non-immigrant for time, and on USTRAVELDOCS you status may totally disappear for a couple days once the visa is issued.

 

NVC processes the K-1 as a non-immigrant visa,  and when you call to get your MNL# you call a special phone number for the K-1.  Still the NVC letter has information relating to an immigrant visa so is not helpful at all.

Thanks everyone for clearing this up. It is quite strange to try to figure this out. Finally got ahold of her. Although she had certified true copies of her allument and NBI clearance they gave her a form to take to have a satilite office send them a copy directly to embassy. Which she did right after she got out. They kept all her papers and passports. So assume this is good news, and just the waiting game now again. She said they hardly looked at anything, no pictures, chat logs, finical stuff. Nothing. She said they were very nice. She showed her her certified copies, she look at them and told her to have the office send them copies directly. If they don't trust the papers people bring which I can understand to some point, why don't they just have that stuff sent to them in the beginning. Anyways, another delay, but don't know for how long espically with the holiday next week.

Ah... that explains a lot.  Usually, once the embassy has the documents that they requested and all else is fine it can still be a week or two before you see ISSUED status.  

 

Philippines is listed as a HIGH FRAUD country, which is why AFTER the embassy receives documents if there is doubt they require the documents directly from the source.

99% of the time there is not a 2nd interview.

 

And yes the holiday will add to the delay.    Just need to be patient.
