List all children you have in any part of the world. This is for biographic purposes but also very important to create a clean immigration trail which can come back and hunt you should you try to petition for any child not a U.S. citizen in the future. Select "no" in the section that asks if child will be applying with you since none of your children will be removing conditions as well. Send in the copy of current birth certificate of the child with your spouse who petitioned for you, that carries weight to prove bona fide marriage. You'll be fine.

Oh I see, in this case then he should just list the child he has with you and send a copy of that birth certificate. He should be good.

I don't think that question 5 applies to you, since you're the USC. Your son (with your GC husband) should be listed on the petition.

I am very sorry to interupt this thread, but my question is related with the topic, so maybe I don't have to start the new thread.

I am a conditional GC holder, ready for ROC right now. Similar question in part 5:

I have an adult son who is not ROC with me. I assume I don't have to include him on I- 751? He is from my previous marriage and he is not immigrating. We don't have mutual children with my USC husband, should I leave Part 5 blank?

You will list him and tick the box that he is not applying with you. You put down the city,/country he lives in.

Agreed with Elly76. Your situation is different from the previous one since this is your biological son. You will list him on your I-751 as mentioned above and select "no" where it asks if he will be lifting conditions with you.

Do I still list my son if he is American Citizen? Is it just for information? Is it because I-751 petition is about me?

My USC husband has two adult children, also American Citizens - I don't list them, right?

I am so sorry it sounds like silly question.
