Can anyone explain to me how the USA residency requirement for the USC & Sponsor works - if living outside the USA.

I read a post on SkyWeb where a lady and her husband actually had to lease an appartment in the USA and fax a copy of the lease to the embassy.

My wife and I live in Switzerland and intend to stay with family (her parents) until we find a place to rent/buy when we are in the USA.

Anyone else been through this?

The domicile issue seems tricky on the face of it, but we had zero problems.

I moved to the UK in April 2001 with every intention of remaining in the UK for many years. I married my British fiance in June 2001 and was issued a permanent resident visa in October 2002. We filed the I-130 in August 2005 and interviewed in September 2006, and there were absolutely no issues with domicile whatsoever. The US Embassy in London's website clearly spells out its approach to domicile with regards to sponsorship; it stated that a proved intention to relocate to the United States was enough. However, on the Manila website it says no such thing. Check the URL I gave you in another thread to see how the US Embassy in Bern treats domicile/sponsorship issues.

You probably will, but you need to talk to the embassy in Bern to see how they handle visas. They don't have a proper field office there but from what I understand you can file an I-130 there. You'll probably have to travel elsewhere for your interview, maybe Frankfurt or Vienna or possibly Rome. I don't know; the USCIS's website really sucks.

Most of us.

It's not the "residency" in the US that matters, it is "domicile". Your wife may use her parents' address as her own if that is where she is relocating to.

Have you had a read through the DCF Guide? There are several links about domicile there that may be useful to you.
