Does anyone know what options a person gets in case of I-751 waiver denial? Can they immediately switch to previous visa like F1 or H1? Or they must need to leave the USA?

They both had their own things to do in separate cities and were planning for her to move to where he was to continue her education. She was not going to move there and have nothing to do. 

 

I've had friends who have been apart for years due to studies or work. I've been in that situation too. I think this is something else. 

 

OP you should make back up of conversations, call logs, joint lease, etc. to prove bona fide marriage. 

 

You probably want to talk to her and make clear you don't want to be apart since you say you love her (but do not mention your GC, loans, money, etc.! You don't want her to think that is what you are worried about. )

 

 

 

 

 

 

 

 

Yeah... When I confirmed her I wont move to another city without her she got restless and terrible; filed for divorce. So what now?

Im a bit hesitant to reply to you further since you advised another in a different thread to record the abuse as proof (which is not accepted) and to stay in the abusive relationship and suffer abuse in order to get proof to file.

 

I am also not an expert on abuse waiver filings. Youd have to get advice from someone like sandranj- however I dont know if she will advise you with all things considered.

 

I can tell you the joint report- if it shows mutual abuse will not be enough. USCIS does not count mutual abuse. In some cases the abused victim is unfairly accused of abuse as well and its very complicated to prove such. Also just because you are getting depression/anxiety meds does not mean you have the diagnosis needed. The meds can be given for a variety of conditions. Ignoring calls? Nope. Or rather you said ignorance to calls...? Not sure what that means but thats not emotional abuse. Emotional abuse is a pattern of humiliation and cruelty. 

 

You are probably better off applying on divorce waiver only. But speak to an attny if you are insistent on going the abuse route. (one thats handled abuse waivers). They can tell you for sure if you qualify.
