hi

don't even try that, removal of cancellation is putting yourself in deportation to see a judge, you are an adult, so no hardship on your mom or brother, you will be deported so it's not worth it.

If I leave the US it will cause hardship for both my mom and me . I only have her ,we came to America in hopes of staying together . I have lived with her all 10 years that I've been . She's been with me all my life . I support her and she support me financially . I have nobody if I go back to Haiti . When tps is expired , I will automatically be in removal proceeding . I read somewhere online when tps is expired and I don't leave the country I will be issued a Notice To Appear(NTA). I looked at all the eligibility , and looks like I fit all description . While I wait for my case to reach the judge , in like 3 years , I will be issued a work authorization , which might help me a lot . I have a current girlfriend who will become a citizen next year . We'll be able to get married and get my green card then . That's the thought process I had in mind . Waiting for mom petition is a long time . It's 6 years wait ,around 2023 . I have nobody in Haiti ,and I won't survive if I go back ,I only have  my mom (green card holder ).

Your hardship does not qualify for anything that will let you stay.

When TPS expires, you do not go into automatic removal proceedings.  You will simply be another visa overstay.  Removal proceedings only happens when ICE catches you.  You are not going  to enjoy ICE custody.  Then you will get deported.  You are not going to get work authorization for 3 years.

Oh really ? Wouldn't the application for cancellation of removal help me not to accumulate days of unlawful presence ,just like tps did for my mom . She didn't have to go back to Haiti , even though she had a removal proceeding (I did too ) before due to the asylum case that was denied . She was able to adjust her status here in USA .

What is your basis for a CoR?

Your mother didn't have to go back because she was a Haitian who was given TPS after the hurricane.   TPS is expiring so you will not be in the same position anymore.

Your mother was able to adjust status because she was legally here under TPS and was the Immediate Relative of a USC.  After TPS expires, you will be here illegally and neither your mother or brother qualify to petition for your as an Immediate Relative.

Ok . I tried again ,because I've gotten wrong answers here already . I asked for my mom in the past , she filed for asylum , got denied and asked to leave the country . THen she got tps  . I posted the question online , and was told she would have to go back to Haiti to wait on her green card . But she didn't have to do that . This time I posted it twice , hoping I would get a different group of people , who might see it and really help me out .

You are not getting wrong answers.  The answers are correct.  You are so desperate that you can't accept the truth.

TPS is what allowed you and your mother to stay here legally.  Once TPS expires, you are in a different situation.

If you don't believe us, then stop posting because the answers will not change.

Can we please concentrate on providing answers the OP wants to hear.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

I'm sure that an immigration lawyer somewhere is prepared to give you the answers that you desire in exchange for swindling some of your money.  TPS is just that, TEMPORARY.

Lol Ok . Thank you .

There's no LOL about it.  It's not an immigrant visa so you're subject to it ending whenever.  At present, your only choice is to return home.  COR is incredibly difficult and requires you to be in removal proceedings and caught by ICE.  Do you really want that?
