Oh really ? Wouldn't the application for cancellation of removal help me not to accumulate days of unlawful presence ,just like tps did for my mom . She didn't have to go back to Haiti , even though she had a removal proceeding (I did too ) before due to the asylum case that was denied . She was able to adjust her status here in USA .

Yes but that doesn't mean staying long.    They get out of the US before they incur a ban, stay somewhere ( can the OP get into Canada ? )  for a long vacation and then back "home" for the medical and interview.  If they are a good medical student how about a study abroad or something of that nature ?

This will not be over quickly. You will not enjoy this.

He will age out.  His PD is not likely to be current until 2023.  Lets be realistic.  How is he going to stay in Canada or anywhere else for that time when he's in the US on TPS?  He will most likely have to return to Haiti until 2023.

 

Studying abroad takes money.  Lots of money.  Not everyone can afford international student tuition.

 

The bottom line is that he has to leave the US before his TPS expires if he wants to benefit from the petition his mom filed.  He can go anywhere outside the US.  Like the song said - Closing time.  You don't have to go home, but you can't stay here.

How would he get a visa for Canada with his history?

Presumably she did not apply for CoR?

No she did not apply for cancellation of removal . Tps became an option for us ,and we were allow to stay . That's how she was able to

adjst her status from tps to LPR . She didn't have to go back ,even though she was under removal proceeding before .

She is an Immediate Relative of a US Citizen and could adjust in country with or without an overstay. You have to be in status to adjust in country.

Me and my mom came from Haiti to United States in july 2007 on a visitor visa.She filed for asylum that same year.It was denied and Was asked to leave  the country before march 2010.I didn't apply , I was a beneficiary on the application . We became eligible for tps and we been renewing our tps ever since.My mom finally got her green card cause of my brother(us citizen ) . She then filed(i130)for me and got approved.My priority date is January 26 2016. I am legal under tps.My Birthday is in June 26 1996.I  will be dropped from F2A into category F2B,which has an even longer period of wait time (6 years+) .The status I have right now,TPS,is set to expire January 22 2018,most likely it won't be renewed,which will cause  me to have to leave the country because of lack of status.I want to know can I file for Cancellation of Removal ?I have  been here for 10 years , and if I were to leave my mom,it would cause hardship for both me and her. I only have my mom ,and going back would hurt me a lot ,as I don't have anybody in Haiti.Can I file for cancellation of removal ,  so I can work in the meantime , I have a girlfriend that I can marry next year ,cause she will become a citizen .  Please help me and thank you

Pretty sure this covered it pretty well.

 

By saying "I have a girlfriend I can marry next year because she will become a citizen" also just sounds bad to me, almost like using her for that advantage. Immigration is not quick, easy, and not always "fair". The TPS status is just that, temporary. If timelines don't work out as you hoped, there still is other ways; but you can't break rules or terms of status just to get what you want.

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

Well you're an adult, you'd have to figure things out.  Unfortunately uscis doesn't take that Hardship into account

Ok . I tried again ,because I've gotten wrong answers here already . I asked for my mom in the past , she filed for asylum , got denied and asked to leave the country . THen she got tps  . I posted the question online , and was told she would have to go back to Haiti to wait on her green card . But she didn't have to do that . This time I posted it twice , hoping I would get a different group of people , who might see it and really help me out .

It covered , but I asked again because I've gotten wrong answers here before . I was hoping to get a new group of people who can really help this time . And about my girlfriend , we been together for a long time, it's not like I just met her . It's not solely for the purpose of acquiring the green card . She in a position to help me . I've asked around(lawyers,avvo etc) that marrying a citizen is my best option . She wants to help get it . We are not doing anything illegal . I'm certainly not breaking any rules . I am a person with good character and integrity . I have no criminal background . I am also an software engineering student at UF with 3.7 GPA . I'm currently a junior . I am good person .
