Hello. My hubby came on a Visa and overstayed.  Believe it or not, I have not found anyone else that has done this.  It has been mostly people who came here illegally.  It would be nice to hear from people going through the same exact process.  Thanks so much

Lol, you have no idea how frequent it is. Happens more than you can imagine. More than 40% of those unlawfully present illegally in the U.S. came on valid visas and overstayed. Either way if you're U.S. citizen, your husband's unlawful presence will be forgiven if he decides to adjust his status to lawful permanent residency.

Adjustment of Status From F-1 Visa.

8/14/2014: Mailed AOS package: I-130, I-485, I-765.

8/18/2014: Accepted in Chicago. Transferred to Nebraska Service Center.

8/21/2014: Received NOA 1. I-130, I-485, I-765 in mail.

8/25/2014: Received biometrics in mail. Scheduled for 9/8/2014

9/24/2014: EAD approved. 36 Days!

10/01/2014: EAD mailed.

10/03/2014: Received EAD card.

10/14/2014: I-485 moved to testing and interview.

1/28/2015: Interview scheduled for 3/4/2015.

1/31/2015: Received interview notice.

3/4/2015: Interview completed and APPROVED!

3/5/2015: Welcome notice mailed and I-130 Approved.

3/10/2015: Welcome notice and I-130 approval notice received.

3/12/2015: Green card mailed.

3/14/2015: Green card delivered.

Removal of Conditions: 

12/14/2016: Mailed I-751.

12/19/2016: NOA issued.

01/26/2017: Biometrics.

05/03/2018: I-751 transfered to NBC.

It also happened to me. My husband is American. I overstayed as I was heavily pregnant at the time. Not really an excuse, I could have left earlier in the pregnancy and go back to the UK but I guess we just couldn't leave each other at the time, he just wanted to take care of me, and this was our first baby. Time passed and I overstayed.

Overstays are second to illegal entry in terms of immigration abusers. The reason you don't hear about it as much is because it gets overshadowed by the talks and coverage of those who entered illegally.

I have been in many other groups, fb groups etc and not one person has said they are in our same situation.  We are in the process now. I-130 will be approved this month hopefully.

It's not something most people say, no one likes to volunteer their unlawful immigration status. By the way you should've filed both I-130 and I-485 concurrently. Most people do that unless money is tight and prefer to file a separate I-130 first. Either way you can still use the notice of action you received when the I-130 was filed, or the I-130 approval notice in the near future to send the I-485 and I-765. Now I wonder if his I-765 fee will be waived though since he didn't file concurrently. Perhaps someone here can chime in on that.

I never even mentioned anything about the forms you are talking about.  We have an attorney and she handles it all.  I am just trying to connect with other going through our same process, that is all.

Just an FYI your attorney sucks.  She should have filed concurrently for your spouse.  You probably didn't need one.  I130 gives no legal status whereas the I-485 does.  You may want to check on that.  Just recently overstays we're going in for a I-130 interview and were arrested by ICE.

The I-130 is the just the beginning for us.  I am really confused here(not to disrespect you) but my topic starter was just to connect with others that have overstays.  I know the I-130 has no legal status.  We still are doing our hardship waiver packet. When my hubby goes for his interview it will be in London.  Am I missing something here?

Ahhh ok that explains it then.  You're doing a CR1 not an AOS.  Disregard
