There is no set time for AP could be days, weeks, or months.  It's not age discrimination.  If denied you failed to prove bonafide relationship.

There is no fixed timeline, unfortunately. No, 1) age discrimination is not something that you can argue for a a visa, 2) how would you prove age was the cause of the denial (with several other red flags anyway), and 3) who would you take to court? CO's decisions are subject to consular nonreviewability. Once the petition is returned to the US, USCIS can review and either re-affirm the case or send a NOID. They cannot force a CO to issue a visa.

Did she frontload the petition?  What marriage evidence did you have?  How many days did she visit for in 2015?

 

You had so many red flags that should've been addressed early on in the filing.  It's a little after the fact now for her to fly to Pakistan and make a case.  Why didn't she do that when you interviewed?  When you have huge hurdles like this you have to research and prepare ahead of time, not wait until the denial and then try to convince.

Lioness Deon we have letters call logs'photographs with my family. Mariiage certificate Nikkah nama and the consular officer kept all those things along my passport and at the end the consular also said what if we give you a visa what will you do when you will go to Ohio. I replied i will be looking forward to a better future for me and my wife.

I'm sorry.  It is something that you both should've have addressed much earlier.  I take it she is not a member of VJ.  These types of reg flags are a common topic here.  

Not much you can do now as I said but wait for the decision.  

If denied you will get a NOID/NOIR outlining the reason(s) for denial.  She can at that time submit a rebuttal and try to reverse the denial.  She needs to be well prepared with lots of evidence.  She will need to make a long visit to you.  It's a very long shot because its all after the fact.

 

Those evidences are not nearly enough.  What about putting your name on bank accounts, wills, life insurance, etc.  You are a married couple. You have to prove as such.

I don't think so. With a 53 year age difference and ALL the other red flags you have revealed, her intervention won't help. I wouldn't expect a decision anytime soon.  I wish you the best, but personally, I would tell her to start planning her sale.....just my opinion.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Good luck with your wife moving to you.

 

This is not like a 20 year old gap which is a huge red flag.  This is you marrying someone the age of your great great grandmother ( as in your culture women can marry about 15 to 18 yrs if age)!

 

i hope the healthcare for her is good enough - if she stays with you for a few years maybe you can reapply....

Please explain how a 73 year old woman met a 20 year old guy in the first place..what was the context and how did you describe it in your application..?
