Hi visajourney members, I am here because I am very confuse what I am suppose to do since I already filed for removal of conditional status unfornately, me and my husband is separated for 1 year and 6 mons now because he is currently incarcerated. I loved him so much and so does he. Time flies and I have been raising my kids since he was gone. When he left, I barely knew how to drive, I didn't even have my own car because he doesn't have any. He was not being so truthful about the situation. I was in a big surprised when I came here in Ca USA and found out that he has legal issues including IRS and tax franchise state. On top of that it wasn't so clear to me that he is actually going to jail until 1 week before our flight to USA , he plead guilty..he is sentence for 4years but got some program that will help him get out sooner. He is about to get out in few more months but no definite date... meanwhile, being separated with him had made me strong and stand on my on feet, from raising my kids, work full time to pay all my bills and going to school at the same time. When I was struggling so much, my feelings for him has changed. I don't feel like I am attractive to him anymore since we are not even seeing each other for almost a year now...I visited him twice at the correctional place and it was very expensive because it was far and I have to get a hotel and rent a car on top of plane tickets... I used to send him letters and pictures everyday and email him... until one day I realized that I don't want to be with him anymore. I am disappointed for everything that I ha e been through all because I married to him. 

I even had a felony case before coz he convinced me that it's okay to leave the kids alone. It was only one time that happened but according to the police officer. He stated he been leaving my kids alone while I'm at work. I was traumatized on that incident but luckily a God is good my case resentlt got dismissed... so I am not worried about that anymore. My question is I filed jointly petition for 10 years to remove my conditional status including my kids but now our marriage isn't going anywhere. Do you think it will be a big problem if we are not together during the process of my 10yrs gc? How this going to affect my immigration status? Do you think the officer will understand that we entered in marriage with the good faith unfortunately marriage didn't work out because he went to jail and I sutruggle to survive on my own?

what should I do? Should I try to stay with him until I get my green card? I don't use him, I feel like I'm the one being used here. If he was truthful in the first place about his current situation I would've not ending up marrying this guy... when he left, I was heart broken. He left me with nothing, and on top of that I had a criminal case against me... it was the worst feeling I could ever imagine and now he just simply think that our marriage is strong and we can just go back together? I don't know but I only feel bad for him I don't love him as a husband anymore... please enlighten my mind about my difficult situation...

any advise will be greatly appreciated.

We don't know how long you've been waiting on your ROC, when you applied, which office you applied at, if you applied jointly with your husband, or with a divorce waiver or what evidence you provided. 

If you have a felony conviction this may be a difficult process. Do you have a lawyer helping you with this? If not, you should get one.

 

This case seems to be very complicated and I don't know if we on this website will be much help to you.
