I can see where the confusion comes in because the contract isn't using USCIS terminology but when in doubt, just don't do anything that could jeopardize your chance of getting your GC.

 

Why not let your husband go on the show by himself? You could be in the audience watching, wouldn't that also be fun?

Oftentimes actors will be hired for 'reality game shows' and get either O or P visas.  They're not residents nor citizens.  This may be what is implied by meeting all other requirements.

Is the free a guarantee of payment for participating.  Or, do you have to win before you get any form of payment?  If there is no guarantee of money or prizes, you can participate in a contest without it being considered work.

Even if the contract says " I attest that I am a legal resident of the United States"?

There's no guarantee. We are facing other couples on the show and filming starts end of June and will go on throughout July and maybe August. I will be receiving my EAD somewhere in between all of this ( I was told end of June by USCIS officer). So I feel like there is a risk but also it can go well. I have already explained in detail to the producers that I have entered on a fiance visa and have married my husband and waiting for GC. I have a SSN but waiting for employment permit. They are aware as it is written in text between our emails.

I was actually only responding to the issue of whether it would be considered work or not.  They will need to seek an opinion from the TV show officials, IMO, as to whether they meet the resident requirement or whether they have met the more general requirement of having met all the requirements to be in the US for participation.

You might be able to request to expedite your EAD. I'm not sure how possible that would be, but it might work.

The requirement for an expedite is a job offer.  USCIS does not judge the type of work.  Worth the time to ask for an expedite if the producers are willing to provide proof of a job offer.

That would not be a relevant term in a work contract that would allow the employer to void the contract and escape paying.

 

The producers can not legally get money back if there is ANY breach.  It must be a material breach of the contract.  Magic words are "material breach."  Not all breaches are material.  Failure to perform the work would be material.  Her legal status is not material.  Google "court orders employer to pay undocumented workers."

Most likely to weed out those without work authorization.  The producers would not have to worry about work authorization with US citizens and LPRs.

 

Just because something is in a contract, it doesn't mean that it's material.  Courts do not let employers get away with not paying workers because of their status.

Okay Jojo, so you don't suggest I follow through with this? Even though filming would start relatively around the time I obtain my EAD?
