When your visa expires is not relevant. When does your allowed stay in the USA expire? (The date should be on your I-94).

my b2 visa expires on may 9. USPS said that I must wait 15 days.

Am I going to be in trouble sending my AOS after the visa expires?

my visa expires in the second week of may. I got married before. but...

- Which is the REAL relevant date?

- the one of the NOA? (that one makes my status to change from Visitor to AOS pending?)

- the one of the marriage?

- the one that I sent the package to USCIS?

- Is it really relevant if you already have an AOS sent?

Since you sent the packet to the wrong place, the only relevant date is whatever is on your I-94 (not your b2 visa).

08/21/08: TSC cashed check

09/02/08: Received NOA...........Priority date: 08/20/08

Yes, they will return the package to you. You can either wait for them to send you packet back to you or prepare a new set and send it to the Chicago lockbox. ALL marriage-based AOS applications are to be sent to the Chicago lockbox. Sorry to say that the USCIS (mis)Information line is not always the best source of information.

I did not ignore the advice. I unfortunatelly got it just after the package was sent :-/ That sucks. The USCIS Call center does not help really much.

meow_mix posted a correct reply to you 25 mins after you asked the original question. I guess you couldn't wait that long eh? ;)

As for the USCIS misinformation hotline, consider that a valuable lesson learned.

Anyway my package was delivered today. I will call USCIS tomorrow to see if they reroute the papers or they send them back. They are supposed to get the i-130 there, at least that was what that form was saying.

The entire package is supposed to be sent to Chicago. Since you didn't specify your state, there was confusion, but my first response was right. You go by what's on the I-485, NOT the I-130.

To prevent from "being in this situation" in the future, heed the responses you get when you pose a question - the USCIS line is known as the misinformation line for many reasons, and you experienced why.

You will probably get the package back, this time send it to Chicago.

I scheduled an InfoPass to see if an immigration officer can assist me on "routing" my package back..I hope it helps.

Hey, I got 3 letters on my mailbox today. I797 notice of action. one for the i130, the other for the i485 and the other for the i765. So somehow everything seems to be still working out :)

Lesson learned.

Thanks to all the people that helped me on this. I am on my way to get my status adjusted :)
