K1 ----> IR-1/CR-1 Questions

Good morning all-

So I will try to keep this brief, I have a few questions.....

A little background for you:  I applied  in May 2016 for my fiancé, our case moved along and he was interviewed in Sept 2016 for his K-1 visa, and was in admin processing and then the case was returned to NVC and subsequently to USCIS.  We  inquired with our congressman who told us that they questioned the validity of our relationship.  We have a few red flags, he is somewhat younger than me and this is my second marriage and neither of us have full, (some) family support..  In any event after  great disappointment,  much contemplation and inquiring with an attorney, who gave us 3 options, (1-reapply for K-1, 2-get married, spend as much time together as we can and show a solid relationship through correspondence, calls, chats, co-mingle finances etc.... and 3-relocate through work or school to another country and be interviewed in the country he is residing in at that time, all of which she said will be an uphill battle :()  I most recently spent 1 month with him in India since we were not able to get married here, we planned an intimate wedding and were married on April 25, 2017 thus leading to our IR-1/CR-1 application that I am preparing. So here are the questions:

1- Since I have not received formal notification from the USCIS that our case is expired or denied, (even after contacting USCIS it was not noted denied, expired...etc.  in the system) Do I have to  withdraw the K-1 application formally in writing?

2- How much do I need to include regarding our correspondence do we need to include......a random sampling from each month since we met?

3- How else can we solidify our relationship to USCIS and the Consulate without going overboard with sumbmission?, we have:

  • I have added him to my healthcare plan (which has an overseas option)
  • I have changed my beneficiary, for my life insurance, Thrift Savings(like 401k) to him.
  • I have added him to my bank accounts as a beneficiary.
  • I have a joint American Express and Citibank Visa card accounts with him.
    • plus we have the standard....
  • travel itinerary, hotel stays passport stamps/visas and trip information from my last visit and previous, most recent visit 1 month.......
  • we have the travel itinerary/tickets/accommodations to Seychelles, where we got married, wedding contract and payment receipt and photos as well as our wedding announcement that we sent out announcing our marriage.
  • we have plenty of pictures  (how many should we include?)  from the wedding and the trips
  • copies of cards, gifts and packages sent to each other

I am not sure that I fully believe that this case will be an issue at the USCIS level, however I am anticipating a challenge at the Consulate level.  The attorney was kind enough to say that she feels confident that I can submit this IR-1/CR-1  application and We can hire as needed for any issues later on.

Am I missing anything here or are there any suggestions/comments from those who have had challenges as such or similar.   I am looking for constructive input, I know that this can be  a difficult case yet I am positive that we can overcome with the right approach.  This is a difficult time for both of us.  We are filled with love and joy in our lives but are separated as a newly married couple.  We video chat everyday sometimes 2 times a day as well as text multiple times a day. It's not quite the same as in person though. Although we have a long journey ahead  we look forward to having a positive and successful process.

Answers:

  • Contact them one more time and see if you can get any kind of status update, don't ask the first person you speak to, they are only call takers who are notorious for giving out incorrect information.  Ask to speak to a tier two person who actually is a USCIS person and can probably give you a true status update.  If the tier two person is unable to be specific, then withdraw the K1 by saying you and the beneficiary are now married nullifying eligibility for a K1.
  • However much you feel is necessary, there is no set magic number.
  • Your list looks good, as for number of pictures, see my previous answer.

April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
