My girlfriend is Dutch and we are living together now in Germany (because I am stationed here)

Does anyone know if it is possible to get married in Holland and file for the DCF in Frankfurt (because that would be the DCF office for Germany)?

Though we already filed for a K-1 visa on the 19th of march, but we still didn't hear anything from them. Not even a NOA1 or check that was cashed.. NOTHING...

That is why we start thinking about getting married and file for DCF if that is possible.

Any input is welcome...

Don't think that would be a problem at all... file the I-130 about 6 months before you are planned to be stationed back in the US...

6 months before I have to go back would be NOW... :wacko:

And I already filed for the I-129 last month. I don't want to make things more complicated than necessary.

But because I still didn't hear anything from TSC since I sent the paperwork, (nothing at all, no NOA1 or check cashed, NOTHING...) I thought they might have never recieved it or got lost. And if that is the case I could file for the DCF thing, instead of starting the whole I-129 thing over, if that is faster.

Just wondering what would be the best option.

Does your unit/post have a JAG or legal office? If so, they may be of help.

01/31/07 - I-130 fedexed to California

02/01/07 - I-130 received by USCIS California

02/13/07 - received NOA1

04/10/07 - Petition approved (64 days)

04/17/07 - Received NOA2, petition on it's way to NVC

05/07/07 - Still nothing from NVC (those bums!)

04/05/07 - Re-filed I-130 at Tokyo embassy with no problems! (didn't need to canx first petition)

04/12/07 - Petition at embassy is approved (7 days!)

04/16/07 - Received notice of approval from embassy, submitted interview request

04/17/07 - Received notice of interview, which will be May 7

05/07/07 - Had interview at embassy, visa approved!

05/08/07 - Passport with visa delivered!!!!

Dang, the Tokyo embassy is fast!

You could give a call to the Embassy in Germany and see if you can file DCF there. Given your military status, I don't think it should be a problem. I believe I read in the Stars and Stripes that DCF for military is high priority for USCIS/Embassy, but don't hold me on that one.

So, give the embassy a call or email them and I am sure they will be able to accomodate you.

edited: If you filed for the fiancee visa and you do go DCF please make sure you cancel in writing the previous petition. You would not want to be asked about that application if you are doing entire different visa category!

Yes, you may marry wherever you like and file where you are resident (ie Frankfurt).

The JAG office probably will not be any help to you with this. Have you thought about the pros/cons of each choice? (I'm trying to think of the pros of filing as fiances from where you are... I'm coming up blank)

The JAG office probably will not be any help to you with this.

I suggested this only because at least here in Japan, the base JAG/legal offices have all the forms and up-to-date info as they regularly work with the embassy, and provide legal advice to the service members here who marry a foreign citizen and are preparing to transfer back to the US.

I know, it seems logical. I used to suggest it all the time myself, until I read enough replies schooling me in how little the JAG wants to do with immigration! :lol: By the OP's reply, seems he doesn't want to see them to start with!

At any rate, I do know that they can marry wherever they like, without impacting their DCF case. Didn't mean to shoot you down. :)

We got married in Denmark, and did DCF in Frankfurt. Worked fine for us :)

You can always contact the embassy in Frankfurt, during my visaprocess I called them a couple of times and they have always been very helpful and nice.

2001 - met in Germany

April 2003 - fell in love

Aug 2004 - go to the US for internship

Feb 2005 - both return to Germany

Aug 2006 - getting married

DCF timeline:

09/01/2006 - filed the petition in Frankfurt

09/06/2006 - medical in Frankfurt

09/26/2006 - faxed checklist

10/05/2006 - received interview invite

11/01/2006 - INTERVIEW in Frankfurt - approved!

11/04/2006 - VISA IN HAND!!

12/21/2006 - POE San Francisco and ON TO SEA!

Hi,

We got married in Denmark and started the DCF in Frankfurt, in Jan. I am still waiting for my I-130 to be approved. My husband works for DOD to a military base in Germany, I should say worked because he got PCS orders and he had to go to the new duty station in US. When we started the DCF we showed them the orders but I see it didn't help the things to be faster. Maybe because you serve in the military to be different!?! Go ahead and start the DCF in Frankfurt. It doesn't matter where you get married, it matters where you reside.
