Timeline

So I read this link outlining the possible reasons for expediting a case.

One of which is: Severe financial loss to company or person.

 

Does anyone know what is considered Severe? How do you prove this?

I cant find any guidelines regarding this.

This is a tough one as in the introduction to the item you linked it says the following:

 

"USCIS reviews all expedite requests on a case-by-case basis and requests are granted at the discretion of the office leadership. The burden is on the applicant or petitioner to demonstrate that one or more of the expedite criteria have been met."

 

To me this says you have to prove the need for the expedite and they have great discretion to approve it or not.  There are no hard and fast rules to severe financial loss, you can only try with the evidence you have and see if they will accept that.  Based on the assumption you are trying to expedite a spousal visa to get to the US ASAP, I would think things like needing to take care of your spouse, or you have a work offer may be considered, but whether that is "severe" if you don't get your visa now is still up to USCIS.

 

Maybe others have more experience, but as it says the burden is on you to prove the need for expedition.

I have seen a small handful of cases approved for severe financial loss. Certainly possible. You, as the petitioner, have to show evidence of financial hardship due to your husband/wife not being here. Like mentioned, the severity of the hardship will get scrutinized.

I have a job waiting for me back in the US. They said they can wait, but I thought this whole thing would be over 1st week of May. Which we agreed would be my start date. 

The immigration is for my wife. NVC tells you not to quit your job, but we had to due to contractual agreements with a university - it would be unfair to them to just walk out mid semester after getting our visa approval.

June will be 11 weeks waiting for approval on our AOS. My work ended in October, granted I have savings... and some odd jobs... its not exactly a comfortable situation, burning through savings. So it is becoming a burdeon. My mom is our sponsor, if that matters at all.
