I-751 Evidence list without sworn affidavits

Hello!!

 

I will be a June 2017 filer and been working hard over the weekend to prepare our packet for submission. The main document that I'll need to accomplish is the lease agreement. We rent a townhouse owned by my husband's cousin so there is really no formal contract signed when I moved in. We will ask his cousin if she can sign an lease agreement form for us. Other than that, I have all the documents that are in the list below and they are now neatly compiled waiting to be sent out! 

 

Question: I do not plan on preparing any sworn affidavits as I feel that we have all the primary evidence covered. Do you think that's fine or is it a must? Although many are saying to submit as much documents as possible, I do not want to annoy the examiner with unnecessary paperworks. If I can, I would still like to narrow done my list below. So your thoughts and opinion will be very helpful!! If you think something is unnecessary, please let me know. Thank you all in advance!! 

 

1.     Payment in the amount of $680 ($595 filing fee and $85 biometric services fee)

2.     I-751, Petition to Remove Conditions on Residence

3.     Copy of Permanent Resident Card (front and back)

4.     Evidence of the Relationship

               i.         California Driver License showing same home address

              ii.         Philippines passport biographical page

            iii.         Report of Marriage required for Filipinos who married outside the Philippines

             iv.         Lease Agreement (PENDING)

              v.         Bank statements of joint accounts

                         o   Chase (September 15, 2015 and April 14, 2017)

                         o   Navy Federal Credit Union (October 20, 2016 and April 9, 2017)

             vi.         Employment Contracts showing that we both work for the same company

           vii.         401K confirmation showing spouse as beneficiary

          viii.         Health Benefits Enrollment Confirmation and Long Term Care showing spouse as dependent

             ix.         Credit cards authorized users statements

              x.         Car retail installment sale contract showing both our names as co-buyers

             xi.         Auto Insurance Policies

                         o   Progressive (March 27, 2015 to September 27, 2015)

                         o   Progressive (September 27, 2015 to March 27, 2016)

                         o   AAA (February 26, 2016 to February 26, 2017)

Don't be worried about sending too much. Send it all. The only things you shouldn't need to send are the things that were already sent for your CR1/AOS. The more evidence, the less likely you will get an RFE or an interview!

Many people say you should submit about 4 bank statements per year (so 8 altogether for each account you're including)

And, heck - throw in a couple of affidavits if you feel like it!

I believe sworn affidavit is necessary since that was listed as one of the requirements on the I-751 instructions. I always believe what ever listed on the requirements list specially coming from the their website will be required and necessary.

Except they're not because many people don't submit them and have no issues including myself. They're easily faked.

The affidavits are not necessary.  We did not send any.  They are listed in the instructions as a type of evidence you can include, but that does not mean they are absolutely required.

Thank you so much!! Okay I will send 4 bank statements per year as suggested. I kept a copy of all the documents we submitted in K1/AOS so I can check which ones are duplicates. Thank you!!!

Okay thank you guys so much! I had forgotten to include in list that we will also submit transcripts of our tax returns where we filed jointly. I hope my primary evidence are strong so we'll be approved even without sworn affidavits. Thank you all!!!

Almost everything that USCIS asks for during ROC can be faked. Its not like they can verify half the stuff shown on documents thanks to data protection laws.

I got the point of possibility of faking it but for me, the more evidence you have the less chances you will get an RFE and interview specially if you provided all the evidences that were asked on their instructions.

Just my two cents
