RFE for an Loi

Friends,

 

 I just received an RFE from USCIS. They informed me that they required more evidence of my Fiancees intent to marry. They said that I can send a letter of intent, wedding plans, or other evidence to prove that she will marry me within the 90 days. On my initially submitted K1 visa application, I wrote a single Letter of Intent(Loi) for both of us, which we both signed, I assume this wasn't enough for the USCIS folks. I guess this means I need to have my girl do a separate letter. Is there any really good templates that you folks used for the Loi, also, is there any documents you added to prove you intend to marry withing the 90 days. Nearly all of our planning has been conducted over the phone or in person(we have lived together for 4 years), so there is not a big paper trial. I'm a bit nervous that they halted an overwhelmingly front-loaded 129F package just for a letter from the beneficiary, My spidey senses tell me they want more!

 

As a caveat, Is it a problem if the Letter of intent is scanned? I am currently at work in the middle east, my girl is in Manila. I made my mother's house in the states my mailing address because I have no way of receiving mail here. That being said, we have to scan and email the Docs to my mom's, which she would mail to USCIS. I doubt that would be a problem but I figured I'd ask.

You both need a separate LOI.  If I were you, I would redo both and send them in. 

 

Yes, scans are fine.

 

You should be able to Google examples of templates.

Hello there, I am a filipina beneficiary. Yes, you need to submit 2 letters of intent that is wet signed and dated. 1 for you and 1 for your filipina fiance. What I did, I mailed my wet signed letter of intent to marry my US fiance. Along with it was my wet signed and dated G-325A and 2 pcs of meticulously photographed 2x2 Passport Photos of me (I sent 2 so the other one is for my fiance's personal keeping). I sent it to my fiance's current address via DHL. Yes, scan documents are OK but I don't think it is still ok if we are talking about signatures. I heard USCIS have become stricter. So what I can at least advice you, you could make a letter of intent there in middle east, wet sign with date and send it to your mom in express mail. Have your filipina fiance do the same thing, send the letter to your mother's address. She must not forget to sign and put date. I saw a lot of RFEs about Letter of intents having no signatures... Then have your mother send those letter of intents to the USCIS along with other evidence you might want to add in your petition... Also if you are not aware yet, in case you got approve, your fiance must have with her another letter of intent to marry you, still wet signed and dated.. Anyway, good luck for your journey and I hope I have helped even a bit..

Wet signatures for LOI's and G-325a's have not been required since 2013, please save your money and scan!

 

They can ask for the original at the interview as stated above, so make sure that she keeps it in a safe place after she scans it.
