Can immigrant family members on I-130 work?

Hello,

 

Can immigrant family members work after coming over on I-130?  Please explain how they can obtain work in detail.

 

I I've read in many places that the lawyers say you can not work.  And, that the I-130 is ONLY a petition to bring the parent(s) over.

Well, it's kinda hard to answer that because the question itself doesn't make sense. An I-130 doesn't grant any immigration status or visa. It only recognizes an individual as a relative to the petitioner so that they can then apply for an immigrant visa.

 

Once the I-130 is approved and a visa number is available (immediately for a parent of a USC in your example), the beneficiary can apply for an immigrant visa. When they enter the US using that visa, they will have LPR status, which allows them to work. The physical green card will arrive later.

they don't come over on an i130, the i130 is the first of many forms, payments and documents needed for them to get their visa

 

once they have their visa and enter the US, they are LPR, with rights to live, travel and work in the US
