residence on 325??

Hi everyone,

Just finished preparing the 129 package and my fiance in the States is about to mail it out tomorrow. However, I have one last question and it's concerning the residence part of the 325A form. I've been in the States on a Student visa 1999-2004 and 2005-2006 on a B2 visa. Obviously I had an address in the States..or a couple...but was that considered my residence? According to Swedish law first it wasn't but then the law changed and they would no longer accept me as a resident in Sweden..but I know from filling out forms that I was not considered a resient of the US during this time either.

My question is: do I fill out the addresses I had in the States during my student years or do I only put my Swedish address??

Appreciate any help I can get!!

Your resident address is where you live. So, if you lived in the U.S., you would need to list your U.S. address.

I don't think you need to worry about Swedish residency law, as Sweden is not processing your application.

Well I guess the important thing was that when you are a student you are NOT considered a resident of the US. The same goes when you are in the US on a B2 visa..you are considered a visitor. However, as a student or a visitor you are bound to be staying somewhere but should this address be considered a residency in the application?

Yes I was talking about the G325..I hope there are no other 325s!!

I suspect you may be using the term 'residence' a bit too technically. They want to know where you were, physically, during the last five years. Not where you TRAVELED, but where you actually hung your hat for any length of time. This becomes relevant to them at the interview stage, as they will want police certificates from the places you lived longer than 6 months to make sure you did not commit any crimes.

Besides, if you were here on a student visa, they will already know that. In which case, it only makes sense to be consistant and list your time here on the student visa on the G325a for the fiance visa. At least the last 5 years worth of that time (your dates suggest you were here longer than 5 years).

If you're still concerned about it, add a supplemental answer sheet to the G325a where you refer to the question on the form and explain that your time here was spent on a student visa.

Oh and the USCIS doesn't give a toss what the Swedish government considers as 'residency'.

NO there are no 325 Forum JUST G325A Forms. Well I would say if you did not legally change your adress when you where in the US then put your home countries adress on the Petition.

Everyone, thanks for all the help. As a lot of other things you just have to take a chance and go with whatever you think is right.

I just use 325 as short for G325A since I assume everyone on this forum are in the process or has been through the process of applying for the K1 visa and consequently very well aware of the fact that there is only one form I could refer to when I write simply 325.

I also know that the US cares nothing for other countries laws/regulations/ways of determining for example residency (why would they in this case?)...like pointed out I've been studying etc in the US for more than 5 years and I'm pretty aware of the ways of government (pol. sci major/master). I simly used the Swedish way as an examlpe of the fact that if the US didn't recognize me as having residency, nor Sweden I would technically not have been living anywhere for a year.

Your advice was good though...I'm probably reading more into it than what it is.

Nah, the whole residency issue is not very clear really. But I say that your perment residency, if you maintained one, is probably what counts. I would make a note about it though, personally.

K1 Visa Journey:

Jan 12, 2007- I-129F Sent

Jan 17, 2007- I-129F has arrived at the NSC

Jan 24, 2007- NOA1 date

Jan 27, 2007- Check cashed by CSC

Jan 29, 2007- Paper NOA1 recieved (at permenant US address)

May 1, 2007- NOA2

May 16, 2007- At the NVC

May 18, 2007- Left NVC

May 30, 2007- Packet 3 arrives

May 31, 2007- Faxed Packet 3 stuff back

July 9, 2007- Interview at Vancouver

July 10, 2007- Visa recieved!

July 18, 2007- US entry

August 25, 2007- Wedding <3

I did a 5 month internship in the US and I wrote down the address where I was living in the US at the time on the G325a.

I think in your case since you were in the US for a long period of time then you should put the address where you lived at during this time. As said above the US government knew you were on the territory during this time, so it wouldn't make sense to me to say you were living in Sweden ...
