K1 - SSN acquisition after I-94 expiration?

Greetings again VJ!

 

Been a minute.  I've been cruising the forums trying to find a solid answer on this because I don't want to show up to the SSA office and get ourselves into any trouble.

 

We finally made it back to the US together and got hitched at the court-house.  My fiancee's I-94 expires on the 23rd of May, 2017 (tomorrow).

 

I was late sending out the AOS package.  It was signed for on the 19th of May, 2017.

 

What I DIDN'T catch, was that we should have gotten my fiancee a SSN 2 weeks after we landed.  I honestly thought the AOS package had to be approved.  That's what I get for lack of due diligence.

 

My question is:  Would we be able to go down and get her a SSN with the certified marriage certificate?  Or would the expired I-94 be a NO-GO at this station?

 

My fiancee is now pregnant and I'm trying to get us enrolled as a family with health-care... which requires that old SSN.

 

Any info is appreciated.  We live in Colorado BTW... if that makes a difference.

Nope. You need to apply for the SSN with at least 14 days of legal status remaining. She will still have authorized stay while the AOS is pending, but not actually a legal status as required for an SSN. She will need to wait for the EAD to arrive (or green card if that's somehow faster) to get an SSN.

 

An SSN is not actually needed to signup for insurance. The online forms may require it, and many HR people may say it's needed, but it's not actually required. I suggest reaching back to them or via the provider directly about getting her added without an SSN.

I agree with geowrian, you won't be able to get a SSN now and will have to wait for the EAD hopefully within 90 days as your wife is currently out of status until the AOS is adjudicated.  As to the health insurance, I would also follow geowrian's advice regarding making contact with the insurance provider directly explaining the situation.

Thanks for the advice.  I'll call the insurance company and see about that.
