So it was because of the robbery charge and now he needs a waiver?

Hope it all works out!

Yes , unfortunately it was because of that . It's really sad and frustrating because the whole process is very confusing with time and money but , I love him and will do anything I can so we can be together . This is another unknown route for me the whole waiver thing 😩😩😩😩 I have no idea how it works or how long it would take .

AGAIN, If more documents or review of the case is needed you are put in AP not "temporary refusal".  I think in the OP case it has been determined the refusal IS NOT temporary.

OP, you can find your congressman by using Google enter your state name and then the word "congressman".  Their website and contact info will come up. You can PM me if needed.

Thank you so much for that link !

You're welcome.  But as I said, congressman isn't really needed now.  They don't file waivers.  Research waivers and hardships.

If everything is good , does it take a long time for the waiver to be aproved and for the visa robbery granted ? And does it cost a lot of money

I-601 application fee $930.  If you use a lawyer to prepare your waiver packet, which I highly recommend they can charge anywhere from $3,000-$10,000 for a good, experienced immigration waiver attorney.  Do not use just any lawyer.  I highly recommend Lizz Cannon.  Her rates are reasonable in the waiver world.  Our waiver took 10 months to be approved.  If you make a profile on immigrate2us.net they have a spread sheet that you can see.  It works similar to timelines here to compare others processing times.

USCIS.gov has processing times listed for I-601

https://egov.uscis.gov/cris/processingTimesDisplay.do;jsessionid=abc7EBDJzB7T8bwRN-7Wv

This shows that they are currently working on May 26, 2016 filings.

Wow that hurts just looking at those numbers in addition to everything else we pay for. Good luck to you and keep your spirits up.

10 months for just waiver actually according to current processing times one year now.  Ours took 10 months. Then after that the visa approval can take a few more months.  You can review my timeline.

I'm assuming after he waiver is aproved he would have another interview ? Is the process similar to the k1 visa process which they ask for paper work from the beneficiary and medical exams etc

One thing for sure, you will fail if you do nothing. You have options, select the one the best fits you mentally and financially. Doing nothing, Im sure you will have nothing but regrets.

Lioness has experience in that and has offered to be of assistance and support. And remember  she was successful. Proof that you can make it.

Pray for the best, always have hope.
