Former national security adviser Michael Flynn will invoke his Fifth Amendment rights and decline a subpoena issued by the Senate Intelligence Committee for documents related to his interactions with Russian officials from June 2015 to January 2017, the Associated Press reported Monday.

The documents were subpoenaed after Flynn's lawyer, Robert Kelner, declined to provide them by the original April 28 deadline. Kelner did not respond to request for comment.

Flynn asked for immunity from prosecution in late March in exchange for agreeing to testify before House and Senate committees about Russia's election interference.

The committees have yet to take him up on that offer, but if they did, then Flynn would be required to comply with their requests, said Andrew Wright, an associate professor at Savannah Law School who specializes in federal criminal law and national security.

Wright said Flynn's plan to invoke his Fifth Amendment rights against self-incrimination "will not play well publicly because many in Congress, the media, and the public will interpret it as an admission of guilt."

Of course because he knows what he did was wrong. He was a very bad choice for that post and I have said that since the beginning. He was to compromised and I also said that since the beginning as well.

And in the eyes of Trump, that makes him guilty. Trump has made that fairly clear in the past. Innocent people don't plead the 5th. Trump also must also realise his own guilt, given how frequently he has used it.

In my eyes it makes Flynn guilty too, but what I subjectively think is guilt is irrelevant.

Agreed. We're both irrelevant.

 

The opinion of the President also won't make him guilty by default, but I do think it is slightly more relevant. Would love to hear from Trump on the matter. Would expect him to conveniently flip on this.

How is Trump guilty if all of this is because of one man who is not Trump?

It is implied based on Trumps own standards and how Trump has used the fifth amendment in the past.  In reality we cannot assume someone is guilty because the invoke the fifth amendment. this is another example of Trumps previous pronouncements coming back to haunt him

I am sure he's taking the 5th to save the country some money. He knows his testimony can't add anything of importance to the investigation. LOL.
