Hi all,

 

My FI and I both live in Romania. I am the American. We want to get married in the United States after we're approved for the K-1 Visa. I'm starting the process now, and as I look the paperwork, it looks like I'm supposed to be living in the states in order for me to apply for him? Is it possible for us to apply for this Visa living together abroad?

No, you can apply while abroad.

Yes you can file from abroad.

 

The payment for filing must be a US money order or drawn from a US bank account.

 

Also, you will have to be able to show finnancial support after the petition is approved during the interview or have a co-sponsor for the minimum 100% poverty guideline.

Hi! Thanks for the quick answer. Do you know if it's okay to use the same address as our co-sponsors (i.e. My parents)? I haven't lived in the states for a long time and I don't think I can get my own address until after I get back (and get a job to pay for said apartment).

Ha, not a chance for me here in Romania :) But I did file tax returns anyway, just to stay legal.

Also, can anyone tell me if Romania is a high-risk/fraud country? I see this on the forums occasionally and I'm wondering if there's a website that gives you this kind of information? Even though we live together, I still plan on putting in tons of documents, so I don't think that'll be a problem.

The embassy may be different but my fiance (US Citizen) is living with me here in Cambodia and we used my parents (immigrants in the US) as our mailing address. They didn't ask for any proof of domicile under his name and he didn't use his parents address because they were moving out of that house before we move to the US.

 

During the interview, the CO only gave a passing mention to how my parents are our main contact in the states and my fiance said that his parents were "not as responsible with paperwork" as mine were, even though he used his mom as a co-sponsor.

 

Speaking of income - My fiance's work here was not considered as American income and that's why we definitely needed a co-sponsor. They prefer immediate family of the fiance - parents, or siblings would be best.

 

Our case was unique because I'm a Filipina living in Cambodia and filing for the K1 in a third country (Cambodia). Cambodia and Philippines are considered high-risk but I do think since we've been living together for a year and a half and that he was present during the interview, it was a lot easier for me to pass the interview.
