Ivelina_Andrew,

Use the must current supporting documents available. Things like tax returns are updated only once a year, but other things like pay statements are updated weekly, bi-weekly, perhaps monthly.

I was reading through here and I see now that we can use the same joint sponsor for the AOS process. But my question is - can we use the same supporting evidence if the timeframe is several months(from April to say, September)? I mean the same letter from employer, bank letter, tax returns, W2?

I am asking because this is quite a lot of papers we should get ready if we have to do it again after several months.

Thanks Yodrak,

yea I guess it is better to have everything with the most recent date. But what about for example the evaluation of the house? His mom is getting that to prove how much the house costs - do you think that we can still use the same statement? And do you think it is crucial if we have the letter from employer from April but present the pay stubs for the time elapsed till September?I am asking because she is very busy and I do not wanna make her do paperwork we can go without.

Thanks again

Ivelina

Ivelina,

What I think doesn't matter, it's what the person who is processing the case thinks. Things like the market valuation and the employment letter can be a bit subjective, which is why I left them out of my original post!

I think that April to September is pushing it for the letter, but if the most recent pay statements are consistent with the letter - same employer, same pay - then the letter might still be acceptable. It's an 'original' right? Not a photocopy? I got a new letter from my employer each time I needed one.

The house is probably not important - hopefully it's not needed anyway? Selling or mortgaging one's home to get cash to live on is not a very good thing to do if one's income is insufficient.

Some points of clarification and an answer:

- The K visas are non-immigrant visas. Immigrant (I-864) concepts do not apply, non-immigrant concepts apply.

- There is no such thing as 'co-sponsorship' for non-immigrant visas, there is only a sponsor. In the case of the K visas the sponsor usually is, but need not be, the sponsor, and will not be the sponsor if the petitioner does not qualify to sponsor.

- The non-petitioner sponsor for a K visa can be a Joint Sponsor (or a Household Member, is appropriate) for the adjustment of status if the petitioner remains financially unqualified. (Financially qualified or not, the petitioner is the Sponsor for an immigrant.)

Last year I made around $16,700 between 2 jobs. According to the 2006 guidelines I made enough but not according to 2007. Which one counts for me? Also, do I and my sponsor need to fill out an I-134 or I-684???

Thanks!

FutureMrs.,

When your finace goes in for his interview your current income at that time will be compared against the poverty level guideline in effect at that time.

Folks, I'm reading this. After searching this website and feeling like I'm beginning to have an idea of the process for the K-1, I have a question to add on to this. What does the AOS phase entail other than the gathering of evidence and (if necessary) working with a co-sponsor? Furthermore, why is it expensive? What do the expenses entail? Thanks!
