I am a dual UK/US citizen now having just moved over from a green card. My three-year-old was born in the USA but is also a dual UK/USA citizen. If I took him home to the UK with me alone, using his UK passport would I have any problems with the customs people on the USA side?

He must enter and leave the US on a US pazsport.  He cannot use the British passport for return to the Us, as he can nm ot e NH term on a visa or the visa waiver program, since he is a US citizen.  To enter the UK, you would obviously then use his UK passport.  (Same for you, of course.)

Thanks for that. I wasn't thinking of returning, my husband would follow a few months later. If I exit on our US passports without my husband would I have hassle from customs? Sorry, I should have made my train of thought a bit clearer.

Timeline

The child needs a US passport. You do not go through customs when you exit the US so they won't hassle you. Customs is checking to make sure you didn't bring anything illegal or over a certain monetary value INTO a country without paying duty on it.

Why not just bring both? Then you and your family can come and go as you please. Please don't think of this as lecturing because that is not my intention, but I may also be in your best interest to keep your son's US passport up to date as he grows so he can use it as he wants as an adult. Again, my apologies if that sounded condescending--my job forces me to look way down the line in many situations.
