Hello all, Just three questions - Please let me know -

1. We are submitting our AOS Application - My fiancé POE on 7/6/2016 and got married on 8/27/2016 - will this delay in submission of AOS has any negative impact on our case?

2. How long AOS process on average takes?

3. I am sending - 485, 131, 765, 1145, copy of marriage license, bank stmt, joined tax return for 2016, copy of lease, our child birth certificate, 2 copies of recent photo - Any thing else you suggest we might add?

1) No, that's fine. You've been out of status since 90 days after your K1 entry, but that will no longer be an issue once the AOS process has started. 

2) Anywhere between 4 months to over a year. Depends on your local office case load and if you even get chosen for an interview.

3) What about i864 and supporting evidence? G325a? I94 and copy of visa and entry stamp? Copy of passport biographical page? You'll need six passport photos total (two for each application). Make sure you have a copy of your certified marriage certificate, not just the license.

9/23/16: Received biometrics appointment letter (day 11)

10/3/16: Biometrics appointment (day 19)

11/4/16: EAD+AP approved (day 53)

11/16/16: EAD status changed to card shipped (day 65)

11/17/16: EAD/AP combo card received (day 66)

12/30/16: Notice of interview scheduled (day 109)

2/1/17: AOS interview (day 142) - APPROVED

2/8/17: GC received (day 150)

 

ROC process:

11/3/2018: ROC window opens

1) No, it will not. 

2) Adjustment from K-1 takes about a year. Could be longer, could be shorter. It all depends on RFE's, background checks, backlogs of the NBC or local field office. 

3) I-864 plus supporting documents (pay stubs, letter of employment, tax returns). Your birth certificate to proof US citizenship (if by birth). I-94 printed out, copy of the K-1 visa and passport, I-129F NOA2 copy. Valid copy of the marriage license is only required for sending the petition. You can gather more evidence of your relationship/marriage, co-mingling etc once it's time for an interview. (if you get one)

01/13/2016: I-129F filed  07/15/2016: K-1 visa in hand
10/13/2016: Filed AOS + EAD/AP.   07/07/2017: Permanent resident (Conditional)
04/16/2019: Filed ROC  11/17/2020: Approved. (10 yr GC)

09/02/2020: Filed (Online)    09/08/2020: NOA1: (NBC
10/22/2020: Biometrics Reuse Notice.  12/22/2020: Online Status Changed to Interview Was Scheduled.  
01/29/2021: N-400 Interview - PASSED! 01/29/2021: Same-day oath ceremony.
