Hello all

 

I am so confused and i hope someone has an answer for me. 

I filed the I-130 for my mom.

It got approved.  She did the medical exam, the biometrics and whatever else we/she was required. 

She received the IR-5 visa and entered the US last September. 

We were told she'd get the permanent residence card in the mail within 120 days. That did not happen. Every time we called or emailed to check, we were told everything looks fine and to just wait. So we waited. 

We even made an appointment and went to the San Antonio office. They also told us to 'just wait' and also told us my mom could travel with the stamp on her passport which serves as a permanent residence card for one year from endorsement (entry in the US). 

My mom left and went back to Albania and already has a ticket to come back before the year is up. 

Yesterday we received a form I-797C in the mail that she has to appear for biometrics in 10 days. 

Now, I understand that sometimes the fingerprints aren't good enough and need to be retaken, but wouldn't the letter state that?

And why would this notice of action be sent to her almost 9 months after her entry in the US?

It states the case type as OS155a which is for the immigrant visa which she received and used it to enter the US last September. 

Embarking on a last minute trip all by herself,half way around the world is a bit hard on my elderly mother, not to mention expensive, and I really don't want her to go through all this stress if this is just a clerical error. In 2014 these were sent out in error and people were told to disregard. 

I don't know what to do!

It doesn't normally say why you need to redo biometrics. She needs to be there for the appointment. Also, she is supposed to be living the majority of her time inside the United States. Make sure she doesn't spend too much time outside so that it will later become a problem. A green card can be revoked for that.

Thank you for clarifying that they don't explain that in the notice. 

And yes, you are right about spending too much time outside the US. She is trying to make her travel plans in to coincide with when we or someone we know travels this way, because she doesn't want to travel alone.  And it just so happens that not that many people travel from our hometown to Austin :(
