Hello Dear All,

 

Greetings to you all who will help this friend know exactly what he should do thanks before hand.

There is this friend that married a USC female since June last year and they have been a lot of issues with the USC lady that she has refused to file for this young man.

she been so mean to him and cruel even threaten him that he will be deported.Most importantly the lady said she wants a divorce but she refuses to sign the documents for him saying she will be the one to file the papers not him.All these is just to keep frustrating this man.

 

Now he wants to know if he can file an i-360 if this is possible?

he already has a divorce from his previous marriage from which he got his work authorization which has now expired.and his not currently working

Please gentlemen and good ladies in the house what can him do as his too afraid to even ask questions from people.

Please if any one has ever been is this situation kindly help this man his going through a lot right at this moment thanks for all your good advice.

He shouldn't be threatened but let him get alawyer to help him there is no way , she can refuse to sign the divorce papers if they are not happy in marriage ... or may be they should sit down and talk with his wife ,, poor man which visa does he have?? And when will it expire that matters alot before anything ,, but he should have evidence as to why he wants divorce but the woman is so mean since last year?? Am prettty sure there is no love,,, but help him get lawyers she will sign the divorce papers ,,

What proof of abuse does your friend have? I've included notes from the Instructions for Petition for Amerasian, Widow(er), or Special Immigrant document available from the USCIS website.

VAWA cases are very had to prove especially in cases where the abuse is not physical as appears to be the case here. If he has some evidence like recordings of her. Statements from mutual friends or family, police reports and the like then he can try. No one but uscis knows how they would rule. Vawa in most cases cuts the abuser out of the process and they wont be asked their side of the story making it prone to abuse by unscrupulous spouses.

Thanks to all whom have given one opinion to the other,is really hard as i don;t know how to guide him but he has some of the hard text messages she sent him like """" keep playing with me until your ###### ### is deported "

   """ i don't need you is you that need me ''' etc

 

 many abusive text messages  that hurts human feelings that i can't start writing them down over here

I have heard what you all just said maybe he should give the 1-360 a trial to see if it will work out for him thanks to you all for your concerns  i really appreciate all the infos you have offered.
