Hi there,

 

I am not sure if my questions belongs here but i would like to know if you move to states with your conditional greencard and you want to do a namechange is it better to wait till i file ROC or should i do it right after i enter the states and file for a new conditional greencard? Do i pay the full fees again for the new greencard with the new name?

I think a little more detail is in order.  Is this a family name change due to marriage, or a legal name change such as changing your first name?  If it is the former, apparently you did not use that name on the initial GC.  I think you can make the change at the ROC stage, but others may have more information.

My daughter will have my husbands last name and we will change hers when we are in the states. I know how to do it i just want to know if it worth to change it when we get there or better to wait till we file for ROC. It is more the question about the fees when you do it before ROC. If i have to pay the same fee for a new GC for the namechange then i would rather wait for it till it is time for ROC.

If you need to change info on your GC you pay. Its about 500$ for a new card. So it would save you money to wait for ROC. And I know this was not your question, but it may not be possible to change your daughters last name to your husbands last name.

 

Yes, there are forms and procedures for it. You submit paperwork and go to court to process it. But what Im saying is they may not allow the name change even if you have all the proper paperwork and the bio dad approves.

 

Anyone can file for a name change but it needs to be approved by a Judge. Judges often will not give your child your husbands last name simply because you are married and its the "family name". They consider it getting a family benefit with out having the actual responsibility that comes along if the child was adopted.  Most places are going to require your husband adopts the child to give the child his last name.

In my case it is possible for my daughter to change her name to my husbands last name. It depends on the law and some circumstances. The consul of the german embassy just gave us the wrong form to sign. Otherwise my daughters name would have been changed already. The problem is to file the right form that we all have to be present to sign the papers infront of the consul. My husband lives in the states and we are in germany. So we will do it again when we are back in the states. But thanks for your advice anyways.
