I-864 new job sufficient support?

Hi .... my husband is US citizen and I am a CAD citizen.  Currently we both live together with our daughter in Canada. He will be moving back to the US very soon while myself and our daughter wait for my green card application to be approved.  My question is... will his new employment in the US count for the I-864?  His previous income in Canada will more than exceed the poverty requirements and his new job will as well. AND yes he filed his expat taxes every  year while in Canada.   Really hoping we would not need a co sponsor for this.  Any insight would be great. Thanks

His Canadian income won't count (but you knew that). His US employment is likely to fulfill the requirements if it is well above the 125% limit for your family and he can provide a letter of employment and as many paystubs as possible. Six months are recommended, but use as many as you can get before your interview. He'll also need to prove re-established US domicile (the Canada consulate is strict about this), but you've got that covered in him moving back.

You may not need a joint sponsor, presuming that his new job in the US will provide him with sufficient income. A contract or as many paystubs as he has when you interview should be sufficient. 

 

However, as I'm all about the "belt and suspenders," if you have someone lined up who is willing to be a joint sponsor, have that person fill out the form, supply their tax return(s) (technically you'll only need the 2016 return or transcript) and send it to you. You can bring it with you to the interview, and if (and only if) the officer seems to be hesitating about accepting your husband as sole sponsor, *VOILA!* you whip out the joint sponsor form and say something like: "We were concerned that this might be a problem so we took the precaution of securing a joint sponsor, and here's their paperwork."
