My wife and I got married last Friday May 12th, 2017 and have a few questions. She entered the U.S. on a work TN visa and has resided in the U.S. since last August 2016. Currently, her work TN visa will expire on 6-July-2017, she also has a business/tourist visa valid until 2020 year. We also just took a trip to Mexico to see her parents, to ask permission to marry, and returned on 17-April-17. Right now we are starting to fill out the I-485, I-130, I-864, G-325A forms to process AOS

 

1. What we would like to know, is because we just re-enter the U.S., should we wait to file the AOS forms post 60 or 90 days to not be considered to have committed visa fraud?

 

2. Do any of you know if there is any chance that the TN visa will require her to return to Mexico for any period of time, and if so, for how long should we expect?

 

3. Being she currently has active work status in the U.S. with her TN visa and it is registered to a company, do we have to fill out a new I-765 form if she is moving to a new company?

 

4. So, lets say she has to leave back to Mexico, being that we are filling AOS under married status, will she return on a CR-1 / IR-1 visa for immediate green card status, if approved?

 

5. If you are paying a lawyer, what type of questions, in brief, would you ask them?

 

Any knowledge will be appreciated.

You don't need alawyer, you can just go and ask them they will tell you whether your good to file or no , if they say your good to file for AOS then go back home use visa journey's help to file your documents .. that's what i did i also had questions on my eligibility to filing but , when they told me am good ,, then i did it my self ,, and i just got my EAD but make sure you put in all the information .. but first ask 2/3 lawyers if your good to file ,,,, goodluck!

1) I'm going to assume that you did not lie about your intentions to CBP?

 

2) I don't think so, but not an expert on TN 

 

3) If she files i765 with her AOS, her EAD will be valid for work with any employer.

 

4) If she leaves without AP (apply for it using i131), she will abandon her AOS application. You would have to do consular processing instead.

If it isn't difficult, it isn't worth it.

8/12/16: POE Detroit

 

9/4/16: Wedding!

 

AOS process:

9/9/16: I485/I131/I765 sent

9/14/16: Received 3xNOAs by text/e-mail (day 2)

9/14-18/16: Received 3xpaper NOAs 

9/23/16: Received biometrics appointment letter (day 11)

10/3/16: Biometrics appointment (day 19)

11/4/16: EAD+AP approved (day 53)

11/16/16: EAD status changed to card shipped (day 65)

11/17/16: EAD/AP combo card received (day 66)

12/30/16: Notice of interview scheduled (day 109)

2/1/17: AOS interview (day 142) - APPROVED

2/8/17: GC received (day 150)

 

ROC process:

11/3/2018: ROC window opens
