confused about k2 visa for stepdaughter

no it is faster for the usc to file. same form just no waiting for priority dates. and no one besides the 17 year old daughter can file for the child since you can not file for grand children or adopt just for the immigration benfit.

Yes, it's faster if the USC stepfather to file for the daughter.  The problem is that it drags this out to 3 years overall and cost more since two cases are required for mother and child to immigrate.  The stepdaughter would have to immigrate alone, get a Re-Entry Permit, and file another I-130 for a F2a case.

 

The smarter move is for the LPR mother to file so that it's only two years overall, cost less because it's one case and not two, and they immigrate together.

Hmm - if she does her CR2 baby cannot join mother.

 

mother can make trips home to be with baby but not too long for correct as she must continue her residency to apply for baby.

 

 

but yes LPR mum filing may be the best solution.  As she is still 17 all should be done before 21.
